Inability to accept payments from a savings acct ripoff

I originally setup a payment plan arrangement to make 2 payments on the April 6 and then another payment on the April 19. I called Wells Fargo on April 6th and made a payment to be withdrawn from my Savings acct with National City Bank.

On April 17th, I received notification from Wells Fargo that there was a payment reversal. Wells Fargo stated it says refer to maker. The lady was rude and stated that I had defaulted on my arrangements.

I called National City Bank Online and they stated that they show that Wells Fargo NEVER attempted an ACH debit from my Savings Account and that my money has been there.

I called Wells Fargo on the 19th and spoke with Wells Fargo and supposedly a manager. I put National City Bank on the line as well. Everyone confirmed my routing #, saving # and that my savings account DID allow for ACH transactions and that the funds have been there and were currently available. Wells Fargo confirmed they checked the savings acct box and NOT the checking account.

On the 19th I made a payment to cover 3 payments. I called several times and verified that they received my payment. Well Fargo confirmed and provided me with a confirmation #. I have monitored my savings account and STILL NO FUNDS HAVE BEEN taken from my savings account.

I called (I can't remember which date) but it was the last week of April and spoke with someone and advised again that me my money was still in my savings account and that the last reversal took 10 days. Wells Fargo advised me to just wait and see if another reversal takes place to call them back and NOT to withdraw any money until (or if) it reverses.

I called 5-1-07 and again Wells Fargo stated my account was current. I informed them that no money has been withdrawn from my savings account as of this date. I asked if I should just withdraw my money from my savings account and overnight it and Wells Fargo stated no reason to because they show the payment was posted.

I called again 5-4-07 and now Wells Fargo informs me that I'm in foreclosure. They stated that my payment of 4/19/07 was reversed AGAIN refer to maker, I asked for the attorney name and they could not provide that information. I have been transferred to the foreclosure dept. 800-284-4322 and then back to customer service because the foreclosure dept stated they cannot provide me with a copy of the notes on my account only customer service can.

I asked to speak with a manager and I was informed that there wasn't a manager available but I could leave a message with Tony Gathers 1-800-416-1472. I left a voice message.

I spoke with Customer Service Rachel, Employee Code: HOX who informed me that she spoke with Joe LaFrance (floor manager) - Joe instructed Rachel with that they can not fax or email me the phone message/notes on my account without a subpoena.

I contacted National City Bank regarding my savings account # and she confirmed my funds are available and nothing is wrong with my savings account. I informed her that wells fargo states my payments are coming back as refer to maker. NCB thinks Wells Fargo has something marked as checking and not savings.

Long story short... Now it's July. I even sent them a money order for one month payment and they refused it because it wasn't all of the payments.

I called and Wells Fargo informed me that I wasn't close to foreclosure. I got home and the Sheriff had already been there. They put me in foreclosure. My money is still in my savings account... I want to pay the Wells Fargo all of my mortgage payments, but I refuse to pay any late fee's... They state they can only remove 1 per year. Give me a break...

Can take money out of my savings without any problems... Why can't Wells Fargo? Never once did I have a problem with. Why did they sell my debt to Wells Fargo...

What to do. Just bend over and take it up the butt and let the Mortgage Company have their way??? Totally BS

You know I was the one calling them, constantly. I never once received a phone call, email or letter stating that my payments were refused. And to get someone on the phone in any department over there is a huge hassle.

Some Depts. A customer is not even allowed to speak with... Give me a break, it's my mortgage loan. Let's get it resolved amicably...
