Repayment plan not honored, late fees and foreclosure threat

My loan was sold to Fairbanks from Equicredit and I was a month behind Fairbanks told me to enter into a repayment plan which I did and they said after the 4 months I would be caught up until august. And after the last payment they said I was still a month behind. And charges outrages late fees. Now I am going to refinance my home and Fairbanks told me they are going to foreclose on my house.
