Abusive and illegal collection practices

I was contacted at work by a lady who stated her name was Miss Leah on 04-28 at my place of employment concerning a matter in her office. I asked who she was collecting for and how much? She informed me that if I did not pay the debt by 12 noon the case would be sent to the courts. I informed her that I did not have the money to pay at the time at which point she became belligerent and started making disparaging remarks.

I asked her to not contact me at my place of employment anymore as these types of calls are not allowed and I ended the conversation. The representative then called my place of employment 3 more times within the next hour asking to speak to my supervisor. She then called the main phone number at my place of employement and told the security guard that she needed to speak to my supervisor to find out how to serve me with a summons concerning fraudulent checks in her office.

Each time she called she was nasty and belligerent to the point that the guard finally forwarded her to a supervisor on duty who did not take the call at the time so she left a voice mail message Identifying herself as Miss Leah with Summit Recovery, in the message she again stated that she wanted information on how to serve me a summons for fraudulent checks in their office and to return the call at this telephone number 1-877-613-9001 ext 107.

I felt the that she had violated at least 4 or 5 parts of Fair Debt Collections Practices Act. I was very mad and upset I filed complaints with the Texas Attorney Generals Office and The Fedreal Trade Commission. Needless to say neither would do anything other than take the information. Needless to say on the same day I received a letter from an attorney stating that I was in the party of a class action law suit against another debt collector, to me this was a God send.

I immediately called him and let him listen to the taped message left, and the letters written by the two witnesses to this all out assault by this company. He immedaiately agreed to represent me and file a federal lawsuit against this company. To those whop say pay your I hope you never have medical problems or any kind of setback. "Its easy to judge when you are in the judges seat"
