I was contacted at work on 3-10 at 3:20 P.M.By a collector names Jemiel Sample. My coworker took a message, as I was in a meeting. When I returned to my office, I was informed that I got a call from a lawyer, calling about "a legal matter, " and that I needed to contact them as soon as possible. Leaving a message with someone saying 'legal matter' is a violation of the FDCPA, as it implies legal action and is a hint to the person taking the message, that the person owes a debt or is being sued.
I called them back to see what the debt was, because I am sure I probably do owe. I requested not to speak with Jemiel, since he had violated the FDCPA. I spoke to two people, one being Sheila Bohanan, that both refused to tell me what the call was pertaining to. This is also a violation of the FDCPA. The final violation that NAR has committed is harrassment at my place of employment. NAR calls my job at least 5 times throughout the day. Even after they have left a voicemail or a message with a secretary, they still call.
They have also been asked by myself, as well as my supervisor, not to contact me at work, but obviously their collector did not note that to my file. I am aware of the laws of the FDCPA, as I used to teach the FDCPA class at the collection agency that I work for. I went online to file a complaint with the Better Business Bureau, and discovered that NAR's membership has been suspended due to action unbecoming of the BBB. I do plan on filing complaints with the FCC, FTC, and the ACA.
I just want people out there to know their rights as consumers under the FDCPA. If anyone has any suggestions as to how I can sue this company for the FDCPA laws they violated, please respond.
