In 1997 I purchased a Home in Oregon under the GI bill.in 2001 I was forced to file Chapter 13 which I emerged from in 2004 ahead of schedule. During the Bancruptcy. Chase Manhattan drug me into court three times in an attempt to recover the property. Each time it was proven that they had received the payments and thier own documentation proved my case. Of course I wound up paying lawyer costs to fight this.in 2004 I sold the home. I was due a refund from the Gov't on my Insurance I paid to secure the loan upfront as this is a requirement from VA. The sum was around $2700.00. This amount is prorated over the term of the loan and the payoff is pegged at what remains on the loan if I were to have died. When the house is sold anything remaining is to be refunded to me. I have discovered that Chase never filed the paperwork for the VA loan instead carrying the loan as a conventional loan whereby pocketing the 2700.00. Now then during the course of my time in court with them they presented papers to the court saying that it was a GI loan when in fact it was not. Do I have a recourse into recovering any money? The house is sold and I have just become aware of this fraud that Chase perpetrated on myself and the court. I have all documentation filed by the court and that filed at the Title company establishing the loan as a GI loan and the Hud 1 form stating where this money was to be paid to the VA. To me its fraud and at one time I was paying for mortgage insurance through Chase when I was in fact already covered by the initial payment.
