On August 1 an account I had with M&T bank was EFT'd for $149.95 without my authorization. I informed M&T bank of this and stated that for all intents and puposes the account was to be closed by me as there was only $1 in it for over amonth. I just never got around to taking the $1 out due to the insignificant amount.
The bank accepted the EFT and procssed it and charged me a $32 service charge for being overdrawn. I explained to the bank in e-mails on 8/02,8/03,8/05,8/06,8/08,8/10, and 8/11 that this was never authorized they should not have paid it in the first place because there was not a sufficient balance in it and that I don't know the company. I even tried contacting the company that eft'd my account and all I got was a recording so I researched their firm and sent them an e-mail from the address on their website contesting their charge to no avail.
The bank wanted me to contact the company then come down and file a notarized report with the local branch contesting it. I informed them I am undergoing medical treatment for posible renal failure and suspected adrenal cancer and can not go through this additional stress of filing all these reports. I didn't authorize it I don't use the checking account and for them to reverse the charges back to the issuer. They blantantly refused to do this stating I need to come to their office and fillout all this needless paperwork.
I reported said company to the NYS banking department and the better business bureau for their failure to comply. They in turn wrote a letter to the banking department and the better business bureau saying that I was only contesting the overdraft charges and I refused without reason to file their paperwork. I have yet to write back on their response due to my ill health.
What is ironic and shows this bank to be a ripoff and only wanting to access unwarranted service fees is that on 8/16 the same company hit my account again only this time the bank reversed the charges on 8/17 without my even contacting them. Why are they able to reverse these EFT charges and not the one on 8/01 when I notified them? If they need my notarized permission to reverse fraudulent charges then they should not have been able to reverse those charges which they again service charged me on.
I'm sure this will wind up in small claims court, however I wanted the public to be aware of these fraudulent deceptions this bank perpetrates on their account holders.
