I, too, have been ripped off, abused and mistreated. We fell behind in December.in January, we received a letter from their attorneys at Moss, etc. Etc. Saying they were going to put us in foreclosure. I called Ocwen abnk, told them we were being refinanced, and I could pay one month (by now we were 3 months behind) and in the meantime, the loan would be paid off. She told me I had to pay 2 months plus penalties. When I told her I couldn't do that, she said I could keep my money, they won't accept one month.
Since we were assured by another financial institution that the loan would be paid off before the end of January, we trusted in them. Lo and behold, Ocwen wouldn't give them a payoff for 2 weeks or so, by that time, they had to pull another credit report, taking 5 points off our credit. Therefore, we have to wait for another month to be refinanced.
Another company contacted us regarding refinancing... Why we said yes to them I now know. They called me within an hour and said I qualified for a Debt Consolidation Loan. On February 11, they requested a payoff from Ocwen... By Feb 22, still no payoff... Sound familiar? I am now in foreclosure and as of tomorrow our condo is up for auction. They added $6,000 in fees, interest, etc. Etc. The other financial institution asked if we could get them to reduce the payoff by $3000. Then we could close on Monday (the 11th of March) and be done with it. They never got back to them... Called me on Friday instead.
I told them, if Ocwen can't make a deal with the other institution, I would have to file backruptcy. The guy from Moss, Fidelis, etc. Said I'll make you a deal... Pay $1300.By Sunday through Western Union, and we will stop the auction sale. He would put this in writing and fax it, in the meantime, I should send the money... My gut screamed NO!!!
Thanks to good friends, we came up with the money. I called him back, but he had left the office on Friday at 1PM. He told me that previously, but to just leave a voicemail message telling him if I had the money or not, then send the money. I told him I had the money, but didn't send it, because there was no agreement in writing...
I called him yesterday 3 times... He's in the office, because he changed the message on his voicemail... No return call as of yet...
I now feel, he won't call me, they will sell my condo tomorrow give me 30 days to get out... Too late to protect the condo in a bankruptcy.
Please keep me informed of any class action suit...
I am still recovering froma car accident suffered in July os 2000. I was close to a nervous breakdown in Jan 0f 2001... During the past 3 weeks, in trying to deal with Ocwen and a few other creditors. I have suffered 2 acute anxiety attaks, with severe chest pain, nausea, vomitting, etc.
My husband and I are fighting about this...
Meanwhile, the refinace is ready to go, if I can get Ocwen to lower their payoff!
HELP!!! I don't know what to do anymore!
Someone please post some suggestions.
