They sold our home the day before Thanksgiving without our knowledge

Attention: Investigative Unit
We are writing to advise you of what has just happened to us with the loss of our home & to make other homeowners aware that it could happen to them as well.

On Wednesday, Nov 24th, the day before Thanksgiving, while outside hanging our Christmas lights, a couple had pulled up, & served us with a notice, stating that they now own our home. They advised us that they had purchased it @ auction the day before. That we needed to vacate the premises within 5 days.

Needless to say, we were we in shock & could not believe them. The documents they had provided us @ that time did not look official. None of the individuals named, or agencies listed on the document were any that we've heard of, or that we were familiar with, therefore it was difficult to & we refused to believe them.

Due to that we received this notice late afternoon the day before a "4" day Holiday weekend, we were unable to contact our Mortgage lender, Ocwen Federal Bank, or our Trustee, Cal-Western, to question or confirm the creditability of their claim until Monday, Nov. 29th 2004.

Needless to say @ that point in time, it was difficult to be Thankful for anything. We are a hard working middle class family with three children, two still at home. We live from month to month. While, we did have some financial difficulties in the past, we were current with our mortgage payments. If a situation would arise in regards to being a few days late, we kept open lines of communication with them. We were never "30" days late with our payments.

Many times when attempting to contact Ocwen, there has always been extended length hold times, as well as being disconnected several times.

On Monday, Nov 29th we found the news to be true!
Our mortgage Co., Ocwen Federal Bank, had auctioned off our home. Now leaving us with five days to pack twelve years of belongings, while trying to find a new home.

While reviewing our paperwork, we found that in the fine print of our Forbearance agreement, it stated that Ocwen could sell our home without any further notice.
Shocked, we contacted a friend who is in real estate, as well as a Mortgage lender. Both had never heard of such a thing.

We then went on to contact a Real Estate Attorney. He stated that he believed we'd have a case, and would take the case for $7,500.00 up front, but could not guarantee anything. Of course, at this time, we could not afford to layout anything.

My husband and I are in total disbelief, shock, and sadness. As are our Children, family, friends, and employers; not to mention the embarrassment.

We were sent a web link by a friend. While reviewing the site, we found we were not alone. There were pages upon pages, of other home owners who have also been wronged by Ocwen Federal Bank. The stories were all the same.incorrectly applied payments, forbearance agreements illegally entered into, and homes illegally foreclosed.

Back in 1996, we had cashed in my husbands retirement fund of: $9,600.00, to get out of a Forbearance agreement, & still to this day Ocwen cannot show us where those funds had been applied. There is so much more to this story, & our history with Ocwen Federal bank, that it's difficult to condense into a few paragraphs.

We've been in a state of chaos since the day we received the notice of sale. We are now in our new address & trying, but are unable to get settled in. I cry every time I need to explain the story, & miss our home terribly. This has been very difficult to deal with both mentally, and financially.

We have sent a copy of this letter to our State Senator, and Congressman, as well as a few News Channels in our area.

We feel that we have been so totally, illegally, wronged. We want Ocwen to justify & rectify their actions.

We have an appointment with a Reporter from our News Channel 3 on Monday, Dec. 13th. They want to do a story on our situation. Hopefully this will get us some help to resolve our situation, as well as to get the word out to others about the Heartless thieves that they are at Ocwen FSB.
