Motion to denie Summary Judgment, Discovery for Docket No. Wesdc-RE-04-34

The Attorneys for Ameriquest have presented more mumbo jumbo. Their contention is that there is no basis for evidence, but for their own. I see it as Ameriquest, and I have records to show a Property assessment that is false, and meant to be divisive in these proceedings.

(Copy provided Exhibit 1.) They know even before court the property is not worth what they assessed it for. The attorney has presented a case of cost before even having the property re-assessed. They don't have to assess it because they are aware that the entire house is not up to code i.E. Plumbing, wireing, chimmineys, asbestos in the cellar, leaking roof, no rear exit upstairs, a 1000 gallon oil tank in the ground of the front yard, and numerous other problems. The integrity of the house has not changed since Amiquest did the assessment.

Most of the Ameriquest motion reads like a form letter, rather then a court fact-finding point. Ameriquest has spent a lot of money, time, and energy to develop this process for court. Ameriquest is a predatory company that has spent a great deal of time to bend the law to fit its property acquiring methods. I believe that the fact of my credit history at the time of this loan, the point I was not employed, (Exhibit 2.) shown by the false exhibit of employment, (Exhibit 3) showing up at the end of the day to sign or initial the agreement before the rate of interest was lost (Exhibit 4.) among (65) Pages, and that they did not pay off all bills in a bill paying mortgage deal proves intent to set the stage to acquire the property.

Ameriquest advertises bill paying and they do ALL the paperwork. The law cannot allow disposition of a contract that is obtained through covert, and deceptive methods. Proof of any action has to be perceived before absolute facts can be presented, there was no reason to suspect Ameriquest of having alternative goals at the time of signing.

Ameriquest has also demonstrated divisional fact statements in the request for summary judgment by presenting, saying, that I have refused payment after missing January's payment. It is Ameriquests policy not to accept payment, unless in full by the following payment, any payments sent before the payments are up to date will result in escrow and subtracted from court costs of Ameriquest. Making it impossible to catch up. If I could have done that, I would not have missed the payment to begin with.

Counsel for Ameriquest has deemed my rebuttal as General Denial, To have the documents counsel refers to would mean I suspected Ameriquest to begin with and sought later proof of their covert conspiracy. Ameriquest has no intent in working this out other than property acquisition. (Exhibit presented by Ameriquest.) From the start they have been totally negative to working out the payment problem, now setting the stage to impossible of ever catching up. This behavior demonstrates further their deceit from the beginning.

There are no issues of limine; issues are in court documents presented by counsel for Ameriquest.

(Exhibit 5) restated testimony of signing person to contract (65 pages long). Motion to dismiss contract without recourse as an illegal contract.
