I originally filed a Ch. 7 but then it rolled over to a Ch. 13. I missed a payment in February and then ran in to financial difficulties in November. Since November I have been current and on time with the payment to the trustee.
Then Ameriquest comes in and says I am two months behind and that I haven't made a payment since June (untrue). Ameriquest filed a motion for relief from stay, it was granted and now they are trying to foreclose on my home.
I have until 11/09/06 to come up with $11500.00. This amount in not correct there are well over $2000.00 in late charges, over $3500.00 in attorney fees and they are charging me for 4 months of non-payment, yet the trustee has made the payments. Oh not to mention Ameriquest just returned $4000.00 to the trustee and now I can't get my hands on it, (trustee is holding on to it).
I have received a forbearance contract from Ameriquest but they want me to pay $3000.00 by 10/27/06 and then starting in Novemebr they want me to pay $3129.06 for the next six months, needless to say that is a little more than 50% of my income. Help if you can.
