SunTrust Bank
Highest-First Posting and NSF Fees Left Account at -$690.00

My account, up to the point I stopped doing transactions because I found out about these illegal banking practices, was in positive balance. Today my account is -690.00 and keeps ticking because SunTrust does not freeze it so they can keep collecting NSF fees (created literally by them).

I have tried to talk to bank representatives (they just respond like robots that it is my fault about the NSF charges) and e-care (online help; they respond a week later requesting that I sign in securely and send the message again). The branch manager in the South Orlando branch (Lisa Santana) never returned my calls. The assistant manager treated me in a very sarcastic way and did not take a bit of a look at my check book activity. Practically she told me I do not know basic mathematics.

The first NSF fees were illegal, as I had cash in my account. They just explained to me that it seems strange, as a $900 deposit I made the day I was charged the NSF fees was in the morning, and that it was cash brought in before the transactions were posted at midnight, which put my account at a plus balance.

They explained that it is SunTrust policy to pay the highest amount first, and on the same day I made a $900 deposit they did not pay the highest amount (I have proof of all transaction dates). It was a cashier's check, which they made that afternoon. This policy causes people to pay more NSF fees for smaller amounts, meaning that if you have 10 $4.00 check card transactions in restaurants and 1 check for $1,200.00 and a balance of $1,200.00, regardless of chronological order they will pay first the $1,200.00 and then charge you 10 times $32.00 per NSF. How convenient for the bank. Besides, they do not tell you this when you open an account with them. I can tell how well trained they are and how often this happens, because they tell you this as if they know new clients will come and complain about these practices.

Here is my first inquiry to SunTrust e-care, to which I have not received a follow-up, and no one has tried to help me solve the situation. This will have a bad impact on my credit report. However, if that happens I will be more than happy to hire lawyers and fight this issue.

First, when opening my business account (IGENTECH, INC), "The representative (Maximo Alyala) did not tell me about holding deposits for 10 days because the account was new." I still have a 3090.90 hold, which is necessary for my business, and the check has already cleared (the issuing party). IGENTECH, INC.

Second, on my personal account, I am not sure, but it seems that your (items on hold/pending) work in your systems as (items paid). I can send a scanned copy of my check book activity, including the printed check card activity from Amanda Ferguson, AVP Banking Office Manager, Orlando, FL, who is the only person who really tried to help me. However, she sent me back to the branch where I opened my account. The manager (Lisa Celentano) was not there. The assistant manager attended me in a very cynical way and did not even look at my check book log. I am sending all this information to you by mail (Your Opinion Counts).

The printed check card activity matches closely my check book records, and there are about 8 NSF fees which are unfair.

If you are able to help, I will be happy to send or fax a scanned copy of my check book and a copy of the check card activity, as logged in my check book since March 01 with a running balance (it matches your check card activity). I did not log charges on the 16th of March and so on. As I am extremely disappointed, I am closing both accounts as soon as this matter is resolved. Hopefully your team is more receptive than the branches I went to.
