Breach of Contract by Vacation Network vacationnetworkinc.com/? Gclid=CMqpqNbegpECFQMZgQodm2jFAQ

Well, it is obvious that I made a poor decision when I purchased my vacation network "vacations" in 2006. I have used three of the six vacations I purchased with my $2k contract. Each vacation was a pain to book, but ended up working out in the end. I submitted for three vacations this year. The first was refused because Destin Florida is not available for my contract type, I had those words removed from the original contract when I first purchased, but apparently how they code your contract determines what they will get for you. So I ended up having to book outside of vacation Network.

Then, the big problems began.in December 07 I sent a request in for two consecutive weeks in western US region, I specified areas I wanted to go to but not resort as under the contract I knew that would make it near impossible to get a vacation. Vacation Network Cashed my Checks December 19, each check covered the $89 booking fee, and the High season fee totaling $269 for each week. I allowed the 4-6 weeks per the contract for Vacation Network to fulfill my request. I even gave them a few extra weeks, and still no phone call from them.

When I finally called in February, they had nothing. The pattern began with a phone call a week from me and still nothing. I was finally told they could not get anything in the area, there just was nothing. So we changed our location to an area deemed by vacation network to be "Low Season" Over a period of a few weeks there was NO calls back from Vacation Network, but repeated calls by me to find out what the status was. During this time I was told "I will send out an email with the request." Now this is three months into the process and they were just now trying to find something for me.

The comments made by the representative force me to believe they had held my money for 3 months and had never even tried to find anything. This would be where I come up with breach of contract by the way. I finally called and spoke to a customer service manager which I ended up calling and speaking to many times, plus emails by the way. Vacation Network finally made an offer to me for two non consecutive weeks. Unfortunately, I work for a living and since I am required to request my vacation in December every year I could not change my time off, but even if I could... Two Non consecutive weeks??? They expected me to travel from Atlanta Georgia with my family, come home for a week, then travel back for a second week... This is not a realistic offer.

This would be the phone call that finally broke the last straw, my patience ended when the sales Rep stated I had got my money's worth out of my contract with a week I had spent in Panama City and that I should be happy with what I had. I called the Vacation Network customer Service manager and told her I wanted OUT of my contract.

After a few phone calls and a couple of emails I was offered $500 of the $1279 they owe me. Not acceptable! I will do whatever it takes to get the refund I am due. To me it's more about principle at this point as a company who makes promises to its clients must be held accountable. Per the terms of the contract Vacation Network is required to make an attempt to fulfill a request within 4-6 weeks of receiving the request. It is more than obvious they could not fulfill my request because it was too late. Had they begun trying to fill the request when they cashed my check a vacation would have been provided for me.

At this time, Vacation Network supposedly submitted to their accounting department for a refund for the two weeks of vacations ($526) I paid for in December 19. This money is on top of the $1279 that is owed to me.

I have noticed a rip off report and rebuttal from Vacation Network, that states "REBUTTAL Employee. AVAILIBILITY IS KEY FOR RESERVATIONS"

My response to that rebuttal is that Availability can only be obtained when looking for it. Vacation Networks obvious lack of effort to fulfill my request clearly shows they were in no way attempting to meet the terms of the contract, therefore the contract should be voided and all moneys paid to Vacation Network should be returned to me. This complaint is one of many I will be filing against Vacation Network. The information above is just part of the issues, I have much more documented through this process.
