Ripoff dishonest fraudulent billing inferior products

We ordered a Fun-Kart Ranger 150 on September 7. It was Xmas present for our daughter. Before I actually placed the order and sent the check, I had spoken to Tony at Right Way ATV several times about shipping, etc. Everything seemed great.

I ordered the go-kart and paid for it with a Visa check from my bank. Once they had my check and cashed it, it was all downhill from there.

The go-kart was supposed to ship in approximately 14 days. When it got to the day before the shipping date and I hadn't received a confirmation from Right Way or the trucking company, I tried to contact Right Way. I was told they didn't have the color I ordered in stock and that is why it hadn't shipped. They said it would ship on Monday the following week. When the go-kart was finally shipped, it was delivered to my husband's place of business.

When the go-kart is delivered, there is no name or anything on the box, and the title is on the bottom. The go-kart must be removed in order to get to any of the paperwork.

My husband put the go-kart together and when he tried to sit in it and couldn't fit, he looked at the title. It wasn't the go-kart we had ordered. This go-kart was smaller and the cost was about $600 less than the one we had paid for.

We immediately tried to contact Right Way. Of course, they do not answer their phone, they do not return phone calls and they do not answer emails. I then sent an email and told them that I wanted to speak to someone immediately, and if I did not, I would contact a lawyer. Within 1/2 hour Sam Brown and Jay Lassiter were on the phone with me. I understand they are co-owners of this business. They told me it would be taken care of right away and they would contact the trucking company to pick up the wrong go-kart and get us the one we ordered. Sounds great, right? NOT AT ALL.

The trucking company picked up the go-kart and a week or two later, we received the one we ordered. Sounds great again, right? AGAIN, NOT AT ALL.

Several weeks later, we received a bill from the trucking company, R&L Carriers, for $943.66 for the return shipping on the go-kart that was shipped to us incorrectly. I called and explained to them that this bill was not our bill. They insisted I was the shipper and I was responsible.

I then called Sam Brown and Jay Lassiter. They assured me it would be taken care of. I have since received about 7 bills, all of which I have refused to pay. I have sent certified letters to R&L, to Jay Lassiter, and to SUNL, who is the manufacturer of the go-kart. Right Way insists it is SUNL's responsibility and SUNL tells us they no longer do business with Right Way and it is Right Way's responsibility. I don't know who's responsibility it is, but I know it's not mine.

I have filed complaints with the Better Business Bureau (in October) and have heard nothing. I have filed complaints with the Pennsylvania Attorney General's Office, which is where I live. They have forwarded the complaint to the Texas attorney general's office. We have not yet heard from them.

I have, however, heard from a collection agency. R&L Carriers has turned the bill over to a collection agency who is coming after me for payment because they still insist I am responsible. Since when is the consumer responsible when a company ships them the incorrect item???

I have again sent an email to Right Way and to Jay Lassiter. They refuse to respond.

The worst part about all this is, we are continuing to have problems with the go-kart. It is not running right and the battery is always dead. I have paid an extra $119 for a one year parts warranty, and we can't even get ahold of anyone to get parts. They don't answer the phone, they don't return messages and they won't answer emails. Not to mention the fact that I'm afraid to even send a part back for replacement because I may never see the replacement.

We are now getting ready to pursue legal action against Right Way. If you check the Texas Better Business Bureau website and type in Right Way ATV, you also get a business named Scooter Town. They have an unsatisfactory rating and tons of complaints. I wish I would have thought to do this before I purchased the go-kart.

Consumers beware: do not do buisness with right way atv or anyone associated with it.
