On November 28, someone named Jim S. Called our home and spoke to my husband. Stated that a credit card we had applied for last year did not get approved and they are going to refund $299 back into our checking account. He told my husband it would take 8-10 days to refund the money to our account.
Surprisingly, he had all our accounting information and re-verified account information and address to my husband. He also gave us confirmation #.instead of getting refund of $299, I notice an electronic deduction of $299 from our bank account on December 4. Due to this unauthorized deduction we have also incurred $90 NSF charges as our account as we had only enough balance to clear utility and rent bills issued before 11/28/03.
Bank cleared these bills but charged $90 to us. We contact the bank and they sent us the copy of check issued by paybycheck.com paid to Cybertel security. Until that point I did not know who Cybertel Security was, and through Internet I was able to find customer service number 1-866-939-4646. I call at this phone number and a guy named Peter Johnson told me that your husband authorized the payment and that I was going to receive a package in between 6-8 weeks. I insist that we had never give any order. He told us politely that your order has been processed already and you can get a refund after returning the package as soon you receive.
Due to my lack of power in this situation I just wait for the package. With every phone call, I was told a different story. When I asked to hear the voice recording of the authorization to take funds from our account, I was given a different reason as to why I could not hear at that time. When I asked for phone number or physical address to the corporate office, he replied that they did not have one but gave ma a PO Box address in Champlain NY. I called them every week and spoke to same guy" Peter Johnson". Every time he told me that their shipment for orders has been delayed. I repeated every time that my husband never gave any order.
He said this question is irrelevant and just wait for two more weeks for package. Last week, when I called after two weeks time limit was over, I had to speak to different person named Steve. I asked him about Peter Johnson, he told that he has no idea who is that person? I was shocked. He told me that he is the final manager/owner. He told us that your package has been delivered already 7-10 days ago. I said I did not receive it. He said this is not their problem and your husband must have given wrong address. I told him that every time I called Peter Johnson he re-verified home address.
I demand postal confirmation/tracking number. He asked me to call him back this Monday (March 22) He said that he would find out Postal tracking number for us from shipping department. When I called him on Monday and asked for confirmation number... He has started shouting and said this is not their problem that whether you receive the package or not. He also said that it is not his responsibility to find out Postal confirmation/confirmation number. You will not get a refund and shut the phone. From my point of view they are just finding excuses to STEAL my money, and others too.
We are new here and are not familiar with American law. I have two small children and we are already in financial crises. Please help us. I know how much hard work my husband has done to earn this money. I want to sue for this money. Please guide me. I wonder if there is a way to get in touch with other victims of this fraud in order to make a claim all together to who may concern.
