Shoddy work, unathorized use of my cc, horrible customer service

I signed a contract on April 20th for a fence priced at $5995.00. I paid $500.00 that day; a third of the balance was due prior to completion and the balance due upon completion. Once we got HOA approval in early May, Cardinal Builders told us that they would start within the next couple of weeks. We paid them a third of the balance around the 11th of May. After a few weeks went by we did not hear from them. We called Cardinal and they said they should be starting on June 4th or June 6th. After repeated phone calls the fence was not started until June 11th. It was supposed to be completed June 12th; however, they did not complete it until the 14th. When we arrived home after work, the fence had split boards, missing nails, one inch boards to cover gaps; they overlapped our neighbors fence by 6 inches. After our dissatisfaction we called the project manager Max. Max and the contractor came out on Wednesday June 16th to look at the fence with my husband. It was at this time, that Max told my husband to go buy the new pieces of wood to replace the ones that were split and they would put them in how we want them. That s utterly ridiculous as we already paid for all of the material in the whopping $6000.00 price. My husband told Max no that is unacceptable, so Max said that the contractor will come out on Thursday June 17th, and replace everything that is wrong with it. When we got home on the 17th, the fence was still not correct. On the 17th the contractor tore out 3 posts to move the fence; concreted them and hung the fence all at the same time before waiting for the concrete to harden. This caused the fence to shift. When my husband called Max, Maxs response was to brace the post with 2 x 4s. The gates are only 3 feet when contractually they were supposed to be 4 ft. The gates are on backwards as well. It is standard in fence construction to use galvanized nails not aluminum like Cardinal did. There is a decent size gap in between the fence and the gates (I can fit my hand through it). There are also nails pops, boards not nailed in at all, etc. It was on June 18th, that a woman from Cardinal called to collect the remaining balance of the fence. It was explained to her our dissatisfaction and that the fence was not completed. She was to talk with the owner and have another contractor call us on the 18th. That never happened. On Saturday the 19th, I received a receipt in the mail for the transaction she processed on the 18th for $3996.66. First and foremost, that transaction was never authorized as the work had to be completed and she had to call us prior to running the payment. The work is still not completed and is sure not worth the price that we paid. Cardinal is in violation of the CSPA 1345.02 (A) (2) Unfair or deceptive acts and practices. They are also guilty of performing shoddy work, as there is a general consensus from many of their consumers who reported to the Attorney General and the BBB. Stay Away! It is more headache than it is worth. I would have been better off building it myself.
