I had contacted this breeder thru an internet listing for a "champion" cocker spaniel. Asked only if he was still available. Candy's reply was, "yes, champion, son currently showing" and she included pictures of both the dog and one labeled as the dog's son. After asking questions on CERF's, why she was selling him, etc., and agreement was reached to purchase this 4 year old champion cocker spaniel. She only would accept a wire transfer as payment, so she was wired over $1800 on Jan. 4th. Due to weather and her having to schedule a health cert for him, shipping was set on 1/15.
Upon later hearing that this dog had no reported offspriing thru AKC, I told her that I wanted out of the purchase, as this dog was not "proven" nor had a son in show - or any known offspring - as she had claimed. She then stated that the people she bought him from had told her he had his CERFs and at least one litter with the "son that is now showing". She had no documentation to prove any of this, but just repeated it as fact when selling this dog. She did, then agree to have a fertility test on this dog on 1/14, and if the test was positive, he would be shipped on the 15th as booked. I agreed to this with the condition that the dog have a microchip number and the vet's signature on the result form and that it was immediately faxed to my vet.
The day before the test was scheduled, she emailed to state that she was not doing the test until the following week as she was "lucky to have a female in heat" that she was going to breed with him! I did not agree with this and stated that the dog has to be tested and shipped as already agreed upon or I wanted a refund. She refused both and did not take the dog to be tested as scheduled. She also did not ship the dog as scheduled. She stated that the test will be done and she is not going to "rush" to get it. Claims that he is not microchipped and if we wanted that done, we would have to pay for it ourselves. This is the only way we had on ensuring that the dog that she tested, was actually the dog that we purchased, as she has severl males she could use for this test w/o the vet knowing which one it is.
We are now out the $1800 plus and have no dog, no papers on the dog, or anything. She just refuses to do anything we request at this point and the female I had planned to use him with is now having to be shipped out to breed with another male of the same quality.
We are wanting to proceed with legal action against this lady.
