Chargeback Claim Investigato

I have worked for Measurecomp for over 5 years, I have held positions in all but 1 of the different departments located at the main office in Oak Park, MI.

In early I was injured at home (I fell through a floor down 2 story's landing on my back) I injured my back and was forced to apply for a FMLA leave of absence. A FMLA (Family Medical Leave Act) provides 12 weeks of gauranteed time off. During this time off the company can not fire you or demote you in any way. I was recovering well and expected to return on or very near the end of the 12 weeks.! Week before my leave was up my father died of cancer.

On the very first day after the 12 weeks were up I received a letter from the Human Resource Director, Chris Beltz. His letter stated I had been fired because I had been off too long. Here is the thing...

My brother in law is the Vice President of Operations, Andy Antonucci. I saw Andy everyday the last 4 days of my father (Andy's father-in-law) life. Andy knew I was almost ready to return. The funeral on April 21 (6 days before my leave expired) I saw my boss Rick Teran and Dwayne Piccinnini. Rick Teran aksed when I was coming back, I told him I dont know the exact date yet, but soon. Rick Teran said "well take as much time as you need" referring to the death of my father. I was in the process of getting the written physicians note to return to work, when this Chris Beltz guy sent me the termination letter. I told Rick Teran about the letter he said "oh dont worry they (Human Capital/Beltz) are required by law to send you that letter". WHAT? There is a law that states a company must fire you at the end of your FMLA leave? I dont think so.

The thing that makes me very angry is the fact that in November the company held mandatory meetings at the office where this Chris Beltz came in and went over the employee manual, page by page. The section that deals with the FMLA is very clear and specific. It states that an employee is allowed to take 12 weeks off under the guise of the FMLA (pending a doctors note of course).

It further states that this 12 week leave cane be extended to 6 months, however at the end of 6 months if the employee has not returned to work then it will be considered a voluntary termination. I was off 12 weeks and 1 day and they fired me. So I guess they only adhere to manual when it best suits them.

I have had many bad things happen to me while at MeasureComp, here is another... in early 2004 the company placed a brochure in our paychecks. This was a program where you could purchase a computer and they would take the payments right from your check. I bought 2 of them. Well Human Capital took the money from my check alright, too much in fact. I called them (Human Capital) and said "hey isn't the payments for the computers over?" they checked and said "oh you are right" and the deductions stopped.

Well 3 years later, All of a sudden I get a letter from an attorney who represents the company that sold the computers. Human Capital NEVER PAID THEM, they took money from my check but NEVER PAID IT TO THE COMPUTER COMPANY! Since my name is on the paperwork, it is my credit report that took the hit. When I took this info to the MeasureComp management, they argued, they even tried to say that they sent me a letter stating that they no longer dealt with the company that sold the computers and it was up to me to continue the payments.

Only after I made mention of litigation did they finally agree to pay off the settlement amount. I have additional even more serious incidents on record (recorded in various ways), some of them include being witness to assault & battery.

Watch out before you think about working there, the management has no clue on how to run a company, all they care about is how much money can they (upper management) make, and how can they (upper management) pay as little as possible to all of the employee's.
