Dear Vic's Heating and Repair,

This letter is in reference to your demand for payment for the poorly performed work at 491 Skyline Dr. WPK, CO 80863.

My tenants called me in March informing me that the GE fridge model GSL25JFPABS S/N F249132 at 491 Skyline Dr was not cooling in the upper portion of the fridge and freezer.

My calendar has me contacting you in mid March and you arriving a couple of days later to assess the problem with the GE refrigerator. I can check my cellphone records if necessary, but you probably have the info in your records. When you didn't show up the first couple of days I called someone else but was assured by the lady at Vics that you would show that day. After you went to check the fridge, the lady at Vic's, told me that you had left me a voicemail with what was wrong. I had not received the voicemail for some reason and told her I needed to speak to you. I called the tenant who informed me that the parts were replaced and the fridge was fixed. Soon after the voicemail came in informing of the cost of the 'repair'. $414.73. I absolutely should have been contacted and authorized any repair as the fridge was 5 years old and only cost $1000 new. That courtesy was not extended or even acknowledged when I mentioned it.

I requested the bad motherboard and you said you would keep it for me. Days later I called and you said you had thrown it away.

I had my assistant prepare a check in the amount of $414.73 check nr. 1005, but told her to not mail it until we had confirmation that the fridge was up and running.

After several visits and parts swapping by you over an almost 2 month period, the most the fridge did was limp along. You offered excuses including poor design of the fridge and lightening damage, but you never were able to repair it. You called the 2nd week of May saying it was fixed and demanding payment of $515.43 for the additional work you had done. I informed you that I wasn't going to pay you until I had confirmation that the fridge was working. I immediately called the tenant who informed me that the fridge was still not operating correctly. At that point, you and I agreed that you would remove all of your parts and replace the original parts which you did on May 12th.

Somehow the 'original' board showed up again as you said you reinstalled it with the other 'faulty' parts. When you replaced the parts, the fridge was left completely dead.

Three days later I had a guy from GE come out. Within an hour he had diagnosed the problem and had the fridge up and running. He said that the original problem was a classic door alignment issue. The door was not aligned properly (you didn't catch THAT?) keeping the switch from closing which caused the motherboard to go into an alarm state and shutdown the full cooling function. He removed the board you put in 200D2260G008, which he said was not the correct board and put in the correct board WR55X10552.

In essence, you should have checked the basic things like door alignment, realigned it and reset the fridge. My tenants would have had the fridge working almost immediately and everyone would have been happy.

Since you were out of your level of expertise, or maybe just looking for easy money, this entire thing got blown up into a huge issue of price gouging, unnecessary work and extended downtime.

I am not looking to "J* you out of paying" as you termed it, but I am looking to be treated fairly. It was only a few days after you took the parts back out that you called and threatened to put a lien on my house. Great PR.

I am enclosing a check for one hour of your labor. Considering what I received in return and my tenants' 2 months of no fridge, that is gross overpayment. If you cash the check you are agreeing to this matter being closed and paid in full. I do not expect a lien to be put on my house.

If you wish to continue this matter in court, I will be more than happy to see you there.
