Tami Phillips, owner of Top Shelf Enterprises is a Standard Schnauzer dog breeder. We have a contract with her for a Standard Schnauzer puppy from her female dog "Rain" which we signed on 5-20-06. The contract specifically specified which male and which female the puppy will be conceived from.
On 9-10-06, we received a letter from Ms. Phillips stating Rain had a miscarriage and had to have a hysterectomy. She stated in that letter she would put our name on the list for the next litter of puppies from another dog the has not even conceived yet.
We made phone calls to Ms. Phillips, which she never returned and sent her emails stating we did not want our name on the list for another puppy and that we wanted our deposit back. She returned our emails again stating she will not give us back our deposit, but will put us on the list for another puppy.
We recently lost our Rottweiler to bone cancer and are still devastated and we want a puppy now, not 8 months from now. Ms. Phillips knew this when we signed the contract, but obviously is concerned only about herself and has trouble selling her puppies, unless the whole thing is a scam to steal people's deposits.
