Ripoff no mattress no money and im still forced to sleep on air mattress until I can find affordable bedding

I purchased 2 queen size pillow top mattresses box spring for total of $579.99 (buy 1 get 1 free) on 4/8/06 from sales rep AT2409 (don't remember his name). Paid in full with personal check. I scheduled a delivery for 4/13/06.

On 4/13/06, I was to receive a call from the delivery team between 7-9am to get an estimated delivery time. I never received a phone call. Therefore, I called the store. Michelangelo Burwell (MB3081), the store manager, told me that he was unsure of what the problem was but was going to find out and get back with me. Hours later he never returned a call so I contacted him. He told me that the mattresses were on back order. I asked for how long. He was again unsure and said he would get back to me.

Again, he never returned my call. And after a week later on 4/18/06, I gave him a call. Again he knew nothing. So I decided to go to the store in person and see if I could get some answers.

At the store, I was informed that the mattresses would be on backorder until after May 2. Words were exchanged about miscommunication with the customer, etc He also stated to my witness and myself I knew that that particular mattress would be out of stock and that's why I didn't wanna sell them. I asked then why didn't you make me aware of that, when I was making the purchase. He replied, yeah I could've told you, but Again more words were exchanged and finally I asked for a refund. I was told because I wrote a personal check; I would have to go through customer service to receive my refund. He provided me with customer service contact information.

I proceeded to contact customer service to receive a refund and to file a complaint. On 4/20/06 I called customer service and was redirected back to the store to gain my refund. I also asked to speak with someone of higher management to solve the problem. I was given the name and number of the district manager. I have called and left several messages with John Holder, district manager, from 4/20-4/26 with no result.

Therefore, I again went back to the store to resolve the issue. On 4/26/06, I again spoke with the store manager Michelangelo Burwell, to negotiate a resolution. I asked for a partial or a third refund and delivery of the mattress because taking a day off from work with no mattress and no explanation inconvenienced me. Also trying to get full refund being referred back and forth from customer service and the store further inconvenienced me. Michelangelo made it very clear that because I got such a good deal they couldn't give a partial refund and deliver the merchandise.

When I wanted a Later, I became frustrated and fed up when my negotiation pleas from the store manager and my calls from the district manager were ignored. I was informed that because I wrote a personal check one would have to be mailed from corporate office and could take up to 6wks to receive.

As of today 5/9/06, I have neither refund check nor a mattress.
