We are trying to obtain a proper payoff and bring our escrow account current in that payoff.

The payment breakdown from our old lender, GMAC, required us to pay OVER our PITI payment to pay back the escrow account that WAS in arrears and that arrears was paid back over a 12 month timeline to GMAC.

Green Tree states we are $8,700 in arrears for the escrow account, this is not true or possible since we paid almost $600 a month over to bring that account current and ALSO made PITI payments on top of that additional amount to keep the escrow account current.

We need an accurate accounting showing current escrow account for this mortgage from Green Tree as they are the new servicer for the mortgage.

When we approached them they blamed GMAC and said it wasnt their problem to fix, really? You are the new servicer and therefore you inherit the account and its issues. Also, they said the money was not lost but applied to misapplied funds and sitting in an account and also applied to P and I extra payments. So YES the money was lost to interest. Who would pay more interest ahead of time and not just pay to an escrow or to principle only?

Green Tree is insisting that the payments applied to principle and interest are no big deal, it is a big deal as those payments have been misapplied and we paid that money to GMAC in good faith to bring our escrow account current.

It is the banks job to have their accounting in line, not us as the consumer. We feel we cannot get a resolution and Green Tree could care less about the truth or fixing this problem.

Lastly we have contacted the Consumer Protection Bureau as we have sold our home and need the accounting fixed prior to close. If it isnt we will be forced to file a law suit. We have requested a corrected payoff and cannot get one, we also cannot see our account on line anymore except escrow, they have blocked us from viewing the accounting details of payments, etc...

Green Tree also didnt have us set up with them with an escrow account paying PITI until our complaints got that corrected.

People need to stand up to the banks and to this company.
