• I have been trying to refinance my home for the past four months under the Government’s Making Homes Affordable Program — HARP program. This program makes eligible loans where the mortgage does not exceed 125% of the current market value of the property
• This being the case, we called Green Tree and were told that we were candidates since the loan is owned by Fannie Mae. However, after trying to process the documentation, Fannie Mae stated to Green Tree and they informed me that they cannot process the application because it did not reflect my name on their records when they took on the loan from Bank United.

• Fannie Mae states that they have only my father’s name being reflected (who is deceased and Green Tree has the copy of the death certificate). Regardless, I was and exist on all legal records.

• Green Tree then stated at the end of February that they had followed all the steps necessary and on March 4 informed me that they were told by Fannie Mae that they “cannot correct the information” as they (Fannie Mae) stated that "they cannot add or subtract to their online files". This response as stated again is not clear since I was with my father on the original record (as well as all certified and clerk of the courts documents).

• I have asked several times what are the next steps that I may take as recourse to correct this information including sending legal documentation? The reply from them has been to send a request (a series of e-mails have been sent to the resource center since 3/14). Fannie Mae has waited days to get back to me and then yesterday (4/18) the same person I have been speaking with on and off since 3/16 informs me for the first time that a “Manu-Refi Plus” needs to be conducted by servicer.

• My attorney had pursued this request originally and Green Tree stated that "Fannie Mae" had told them that they cannot do anything as this was originally how the loan was given to them (Bank United the original servicer states that both my father who is deceased and myself are on that loan that was taken over). Both these entities are stating to go back to Fannie Mae.

• I have asked this individual’s for her supervisor's name. She stated that she could only give her first name (“Julia”) and no last name and that she was unavailable (4/18 at 10:26 am). I had requested to speak to her supervisor as the information that she had given me was the same with the exception of a “Manu-Refi” plus which the servicer cannot do (Fannie Mae did not allow when Green Tree tried).
• As per my attorney, I am requesting their legal department's phone number so that my attorney can work directly with them to take care of this. The individual stated to call back the 800# as she does not have this information (a circular loop because they ask you to speak with Level 2)
• In addition, if the perplexing statement made by Fannie Mae’s representative is true and if my Father is the only one on the loan, then who is the party responsible for this home absent my father?
