Scam of earnest money for home

I hired this person to find me a home at a cost of 300 dollars which she never did and when i found a house and asked her to get a contract she took $800.00 dollars down as earnest money for a fannie mae home.

She has not returned the 800 dollars of money and she keeps saying that it in the mail.

She is holding money and thats illegal. I want my money back...
