Early termination fee dispute: CB unable to provide reliable service or device

In April of I paid an additional fee for a Huawei U8500 Android phone - upscale for the one they offer for free (Alcatel 990S Android) with new contracts, and I took their insurance on my Huawei cell phone device. I filed an insurance claim for my broken phone and received in return for my Huawei, the Alcatel 990S. I had various difficulties with that device; it would shut down spontaneously, drop even more calls that Cincinnati Bell usually drops, and the alarm clock feature failed causing me to be late for work. I was offered a replacement & got another identical Alcatel 990S that had all of the same problems. When I moved on 5/5 to my new address, my service became very intermittent. I was told that when my fiberoptic TV and internet service was hooked up, and I attached my cell phone to that network. That communication was by Kelly via e-mail. Well, I continued to have ALL of the same issues, being late for work because of phone device failure, and missing important calls and notifications of people wanting to enter my gated community because of lapses in phone service. I called service many times and spoke to Marvin and Renee and various persons. And I was cut off many times because of phone service intermittent failure. I told them I could not live like. They offered me $200 toward any new cell phone at their stores, but I reminded them that the cost of the "freebie" Alcatel 990S was $239, so I doubted that this offer would resolve me problems, and that I should at least be afforded an upgraded phone such as I had originally purchased. Problems persisted and despite more calls, but they CB reps were unable to resolve my device and service issues. Finally, on 5/12, I ported my cell phone number out to Verizon wireless and cancelled Cincinnati Bell. I asked to speak with a supervisor on various occasions in appeal to have the early termination fee dropped. On both occasions, I asked to speak with a supervisor, and was told that I already was speaking to a supervisor. I explained that even while on the wireless network, I could be sitting next to the router by the window and my device would say, no service - then have two bars - then have 4 bars - then have no bars - then have no servce - then have 1 bar, etc. Many times I missed being contacted because of no service. I requested transcripts of all of my contacts, and was told by the last lady that my service calls were documented, but they could not provide me with the information, and that I should not have ported my cell number out, so the early termination fees were valid. BUT I DID NOT HAVE THE SERVICE!!! So, I am very upset that CB wants to charge me $217 for THEIR inability to provide me with a reliable device and service. I feel it is unethical and criminal.in these cases, I feel the ethcal thing for CB to do would be to rescind the early termination fee and admit their inability to provide reliable cellular service and a reliable cell phone in some cases, as it certainly was in my case.
