Watch out for the leases upon turn in! Even when done correctly! Arizona

My wife and I purchased via lease a 1999 Ford Windstar van while I WAS EMPLOYED at Star Ford. We fell on hard times during the 3 year 36,000 mile lease and had to extend the turn in date from 8 till February. Before taking vehicle into dealership, I had several conversations with Ford Motor Credit collections about how to turn it in and even sent the payments (western Unoin) that were due upon the turn in of the vehicle. AT NO TIME WAS THIS VEHICLE DISCUSSED AS BEING A REPOSSESSION OR DEFAULTED IN ANY WAY.

I returned vehicle to Star Ford @ Oxmoor on the assigned date (in fact Ford Motor Credit sent us information on how to turn in properly two months prior) At the time I was told how much the van was going to cost which was over $3,000 more than the original lease was supposed to be for. I was told due to my credit history that Ford Motor Credit would not take me and that he could not get me ANY financing for it. With this knowledge I turned the keys in and I was told that I would get the bill for the overage on the vehicle. No problem RIGHT!

I then start recieving calls from Ford Motor Credit that I owe the over $9,300. I asked why it was so high, they said the this was a repossesion/default and that I had to pay the difference because Star Ford sold the vehicle art Auction for only $5500, plus late fees and that I still owed for three more months. Heck, I could've gotten a loan for that and why didn't they mention these payments before I turned in the vehicle. We paid for 36 months. We have aslso told them we would pay if they could send me a BREAKDOWN of the costs and fix the reporting to the bureaus since this was not a repo. I was met with great resistance.in fact, I have heard from them since the summer of last year

I just recieved a summons from our Sheriffs office this week that I'm being sued for the $9300. This is unbelievable, i agree to pay them and work out payments with them based on the milesage etc, but i am rejected mulitple times neither group will provide information to me so i can assess the situation and i'm getting sued by them. Even in the documents provided bytheir attorney it is false.
According to the lease papers I signed I could not be offered the vehicle if i was in default/repo stage. While clearly, I was not allowed to purchased based on the financial information given to Star at the time we turned it in. We had the vehicle legally for the terms agreed upon in fact a whole 6-7months more baseds on the arrangements I had with FMC, so if I was in default why did they not come and get the vehicle or tell me of the financial obligations when turning it in. We are only responsible for the overage put on the vehicle. They do not want to acknowledge that. Helpp!
