Center Phoenix ripoff lies deception uninformed repo misrepresentation down payment theft

NOTE; This website is right about the BBB, as I was unaware. Just like I used to be about who owns the Fed. Reserve, World Banks, Media -etc. Another story.

But here is ours. ALL WITHIN THE LAST COUPLE DAYS.

My note to CAG Finance. After I got a late payment notice when Chapman took the trade and was to pay it off.

It has been an absolute nighmare dealing with chapman auto. The 9/11 payment should have not been owed by myself because chapman took the car -that is bought me out because i needed a newer car due to it had transmission problems and i needed a much better interest rate which they said was accomplish by at least 12%. But of course they needed more money down again and again.

The manager lewis calmly said i had to the end of the month to finish paying the down on the chevy blazer 1999-which i had possesion of. And to my horror was towed away at my place of work-the spa at gainey ranch by a man wearing a bounty hunter t shirt.

The manager thankfully approched me and said it was all on film. But even this character looking for my car in the private garage for class clients said this was strange and to contact an attorney.

I am happy to work with you, but now with the lies deception unfair business practice-how am i to know that you ever receive any money i give chapman toward a vehicle.

My father is employed by the government and has worked cia for many years. He assisted me with the first manager who pulled the new car switch which on the contract was stated as used, 30000 miles. And he was helpful thereafter.

But he is no longer there. This lewis mgr is much more sarcastic, rude and dishonest., now i must get the inside story.

I don't understand how or why this occurred. Something is surely not right. Please call me to let me know where we stand.

He is even trying to keep or swallow my down and only return the last 1000$ payment less a 350$ towing fee. I will get the receipt from driver.

I lost everything awhile back due to hardship and family health problems and work hard to rebuild our lives. I will not allow these con men to rip me off, thank you for your time and consideration.

I appreciate your help. I know they screamed at christina your employee when she called and they would not give my husband the managers last name-obviously they have something to hide or defend. It's quite clear. He even said go ahead sue us.

complaint:
chapman of phoenix sold us a new car-stated used on the contract. They wanted it back 3 weeks later., after thousand$ down we traded and used the applied down payment for an explorer-31% interest it had a bad transmission-then we traded up for a newer car. 1999 chevy blazer. 3000 more down better interest.

The interest problem stems from social security taking two years of no work to honor my husbands disability claim-took 25 years for a diagnosis-another story. Manager said i had till end of month 9/31 to finish paying down.

Today they towed it from my job!!! Manager lies says he didn't say that.in fact he told me we have a new contract he found a better deal one less year less interest-more down.- he won't give last name-sales man no longer there that witnessed. They switch managers and sales people so often so they aren't accountable for the deals they make, then they try and soak more money out of people or they somehow loose their car-no warning-no fair options. Coverup lies.

My husband is disabled i am in pain from an auto accident trying to work and we have a daughter. Am i supposed to loose 5000 $ and have no car for groceries work school doctors??? Please advise.

National Consumer Law Center, Unfair and Deceptive Acts and Practices, sec. 5.4.3,5.4.5 (NCLC: Boston 1991 & 1995 Supp

Perhaps even more persuasive to a jury is the type of testimony that may be obtained from the dealership's own personnel, who may see nothing wrong in swallowing downpayments, trade-ins, and rebates. For example, one salesperson recently admitted under questioning "If the customer doesn't specifically say their down payment is supposed to reduce what they owe us, I assume it all goes to profit. Some customers don't mind that all, you know."

Consumer Remedies
Swallowing cases should usually include tort claims such as fraud or conversion, so that the consumer can seek punitive damages. UDAP claims should also be added because the proof standard may be easier, the dealer may have engaged in oral misrepresentations even if there was no theft, and because attorney fees and multiple or statutory damages may be available.

Swallowing in a credit sale probably involves a Truth in Lending violation because the amount stolen may be a hidden finance charge, so that the lender is liable for statutory and actual damages and attorney fees. Similar remedies may be available for lease swallowing under the Consumer Leasing Act, since the lessor may misdisclose the capitalized cost reduction or trade-in, and because the swallowed amount may make the early termination penalty unreasonable.

The consumer's attorney should subpoena the complete "deal jacket, " including preliminary or draft worksheets, which may differ from the final worksheets. These documents will trace all credits and debits relating to downpayments, For example, a dealer's used car inventory may show the net value of a trade-in vehicle. Trace that sum through the "deal sheet" which summarizes the lease transaction. Does the net value decrease the consumer's obligation on the new car or does it go just to the dealer's gross income?

You may also have to trace the dealer's "cash sales" account to see if rebates or other amounts have been "washed" this way. All forms of dealer swallowing have one constant: the dealer must manipulate numbers for both the customer and the dealership

If the general manager or owner does not satisfactorily resolve the problem, a complaint may be filed with the Auto Industry Division (AID). EXAMPLES OF A COMPLAINT An inquiry into a complaint is limited to alleged violations of the motor vehicle law. Examples of law violations could be: Failing to deliver title within 30 days of the sale. Failing to meet all terms and conditions contained in the written contract. Tampering with an odometer or giving a false odometer statement. Willfully misrepresenting or failing to disclose any information required by law. Intentionally publishing or circulating any advertising that is misleading or inaccurate. Selling vehicles that do not meet the safety and emission equipment requirements. How the scam works: Lots of people email us about this scam. You trade in your old car, and the "LieNance" manager says you got a good APR, hands you the keys, and you drive home. Two weeks and 500 miles later, they call you saying "Sorry, you didn't qualify for the interest rate we signed you up for". This is where "subject to financing" clauses on contracts bite you in the butt. Everyone thinks that you sign papers and drive off and the deal is done. But it's far from done. They knew what you qualified for before you signed, unless you lied about your income. Otherwise they'd never let you drive off with the car.

1) they bait and switch

2) Neglect and USE my property (collateral) by letting disgruntled employees drive. I Am having to fight to get my old car back, STILL WAITING WORKING -WITH NO CAR-AND THEY WON'T TALK?

3) False guarantee that all cars undergo inspection and are in great condition.

4) Refuse and neglect to provide reasonable info. Regarding the vehicle history. CARFAX SHOULD BE MANDATORY

5) Sell cars "as is" with a warrantee and then they don't honor them. They will procrastinate, till your warrantee runs out.

6) Illegally reposes most of their financed cars and resells them, over and over and over again! After NO WARNING OR REASON they repossessed my car!!!

7) They eagerly anticipate the repo of all their customers.
AND THEN ARE SMART AS ABOUT IT AS IF gods or kings. To subserviant.

8) they brag about said repo (s) and were smug would not give their names or dealer lic # to hubby who was on first paperwork.

9) Repo men endanger lives of customers recklessly speeding out of driveways and through neighborhood (s) AND TRESSPASSING..

10) Cause unnecessary stress in their customers and family lives. Get to md get to school... WORK.

11) Witnesses to the repo men stalking around my neighborhood well before the payment is due.

14) Repo men fails to show identification.

15) Repo man showed no concern with my intent to make payment) in good faith. Explaining, but even he said this was very strange to hire legal representation. AFTER HE EMBARRASSES ME AT MY WORK - HAVE THE FILM.

17) AS members of NADA (national automotive dealers association)... They are required to employ knowledgeable
employees... They failed

They neglect customer request's & pleas to inspect potentially dangerous problems same day of purchase.

My contract is in default by chapman-but i was told a new better contract was made less interest but more money down again

Refuse and/or neglect to check into potential defaults in a reasonable (quick) manner.

Neglect items holding as collateral and fail to keep them in good faith (they don't even know what they have) Regular policy of keeping collateral with no intentions of returning it

What really happened.
Dear to whom it may concern,

I am certain there is unfair and possibly illegal business practice with chapman auto sales of phoenix.in fact the manager lewis wouldn't even give my husband who is disabled his last name when he called to find out what was going on. Even the tow driver said this was very strange and to hire an attorney.

Arizona fair honest business. I was told by the manager i had until the eom to finish paying deposit, we had not even signed the new contract yet when to my utter terror my car is towed from gainey ranch where i work. Total horror and embarrassment. Emotional breakdown. It was that bad. Ask the village spa. This is about honesty or the lack thereof with auto dealers.

My husband suffers with a painful disability, i may have said that but 24/7 chronic pain-tough. I am trying to continue working after a car accident caused me whiplash and constant pain, that on top of raising our precious 9 year old daughter. They take our only car and then when hubby calls lewis the mgr is smug about it. No one cooperates.

This is not a case where we were 3 months behind or anything like that.in fact they once sold us a brand new car, 3 weeks later took it, this was a year ago and financed another car with a couple thousand down. Made tranny noise not covered. We used that as a trade for this blazer. Plus a few more thousand. So all in all they have thousands of our dollars. Of our money just in down payments. The thing is they called and said they had this great new contract. And all this of our car being taken was out of the blue and unexpected. We were lied to - robbed. They could have said anything like we need to negociate the time frame-get another vehicle but nothing-no chance to clear up a problem even if there was one.

I believe they are trying to pull something. Obviously. At our families expense. They may have found another buyer with cash. I want the truth. I repeat-does this sound like anything relating to fair, kind treatment of customers?

I'm not even sure they are licensed to sell the first new car they did because i noticed on the contract later it said used vehicle 30000 miles-untrue.

And i think they just found another cash buyer or something. And they say they are keeping all my money except possibly the last payment on the down-less 360 towing fees!!! That's my daughters entire disability check.

Please help us expose unfair rude and hurtful car sales like this. And somehow get our money at least a car. What is our family to do with no car. If something was due to the point of them taking it i certainly would requested help from family. But they just send a tow to my work -!!! I am so embarrassed. Angry. Conveniently the car salesman is no longer there to verify his promises. They are doing a good coverup.

This is still america i have to believe someone will help. They made no offer to do anything-just screw you was their response. They didn't act like that when they wanted our money.

WE ALREAdy lost our home and car waiting for SSA to honor his disability claim. And are rebuilding our lives. I can not afford to be ripped off by a used caR manager who is driven by dollars without human morals.

I ASK assistance and exposure, support of any kind is greatly appreciated.

Ps-they move their managers and sales people fast so they are unreachable or don't have to answer for their verbal commitments.

call me please for true story. I just want my car for work shopping doctors and school and willing to pay, even get into something less expensive if need be-i can't let them steal our money for nothing.

Please. We may have to move out of the leased condo-back into a 8 by 30 foot trailer. Before his we were planning on buying an old house by olympia, wa. Owc. Damn. We rented a car for 5 days-best we could do. Anyone have a car for rent?
