Company engaging in fraudulent business practices to steal money

Ms. Tumay, my employee, was directed to Kinetic's web site wherein she ordered a "free trial" of a teeth whitening product. Ms. Tumay believed she was only receiving a single trial product and that she would pay a one-time shipping and handling charge of $1.99). She was not aware that if she did not return the product within 14 calendar days (which was impossible because she did not receive it in that time), she would be charged $84.71 for said "free trial." She was also unaware that Kinetic would continue to charge her monthly for the same amount unless she "cancelled" her account.

When the product arrived and she learned it was a fraud, she attempted to return the product and cancel further shipments. Kinetic refused to allow her to return the product because it was not within 14 calendar days of her "free trial period" which they claim commenced when she pressed enter on the computer - not when Kinetic shipped the product or even when she received it. She even called within 14 "business days, " but they assert that they do not go by "business days" - rather they use "calendar days" to measure the alleged "free trial" period (again, whether or not the product has been received.)

Kinetic Promotions LLC has an address at 5348 Vegas Drive, Las Vegas, NV 89108 (most likely just a mail drop for their licensing purposes). They have a phone number of 877-254-0865.

On January 4, I spoke to a supervisor named Joshua. Joshua refused to refund any monies or accept return shipment for the unused product (it was never opened) and only confirms that the account has been cancelled for further shipments. He also confirms the fraudulent practices of the company - commencing a trial period both prior to mailing the product and/or even charging the customer for shipping the "trial" product. His excuse is that the practices are explained in the "terms and conditions" on their web site (which, he also admits, are only available if you click on a link to review them prior to purchase).

Ms. Tumay has reported the fraud to her bank and is attempting to reverse the charges. A simple search on the Internet evidences that this practice is common for Kinetic Promotions and this company also continues to attempt to charge a "customer's" credit or debit card even after a request has been made to cancel further shipments.

Kinetic Promotions needs to have their license to do business revoked due to this unlawful business practice and fraudulent activity and we respectfully request that the Secretary of State investigate and revoke their license to do business in Nevada.

One of Kinetic's web sites is found at www.hollywoodbrite.com. Kinetic also sells other products through different web sites, each with the same "terms and conditions."

I understand that one of the officers of the corporation resides in California. Perhaps a B&P 17200 claim should be filed against them to get them to cease their unlawful business practices and refund ill gotten gains to their victims.
