Issued wage garnishment for debt already paid off

Two weeks ago, my employer received an order to deduct 25% of my gross wages to repay $706.84 that I allegedly owed to EDD for an overpayment of UI benifits some years ago. This is a re-instatement of a previously repaid debt, plus all interest to date. The original debt was $330.00, plus interest, and California collected about $600.00 already to satisfy this debt a couple of years ago through wage garnishments.

I never received notification on either garnishment from EDD. This second garnishment was set up in such a way that my employer was unable to notify me before deducting 25% of my gross pay. Since California is broke, and issuing IOU's that are worthless and now heavily regulated by the SEC, there is no hope I will ever get this money back. My employer has provided me with a copy of what they received from the San Bernardino County Sheriff's Office in this latest garnishment (Sacramento County Superior Court case# 07ED01332). Because the case was prior to November I cannot access the records to find out what is going on.

The Franchise Tax Board has refused to obey a court order to enforce a judgment on a previous employer from the State Labor Board. But, they are quick to collect by any means necessary monies from those who cannot fight back (see my complaint on PDM Express, the company that kicked off this whole mess). Now, the state is re-instating debts already resolved or paid off, claiming to have never been paid at all.

No one is answering phones at EDD in any department. I was forced to leave a message with their web master to please have someone call me ASAP, since there is no other way to contact anyone by any means at this point. A check of their automated system shows I owe them nothing.

If the previous garnishment did not satisfy the debt, I see no way how this one will. It appears I will have to repeatedly give up 25% of my wages until I no longer have anything left to give.

I repeat, I do not owe ANYTHING to the State of California.in fact, they owe me money still from my taxes for last year (but have yet to pay). This is a reinstatement of a previously resolved debt that was paid off in 2007.

I will lose everything, including my home, by the end of this month because of this latest action by California, and I have no recourse. They know it, too, and are counting on the fact that this case simply isn't worth it financially to a lawyer so I can't fight back.

Way to go California, drive out what is left of the employed workforce, even if it means driving them into grinding poverty and homelessness, and destroying them financially for years to come. I do have one recourse, and that will be at the polls at every single election.
