Refusal to release insurance proceeds from a fire

We had a fire in our home on Feb. 3. The insurance company made the check for repairs out jointly to myself and my husband, and Countrywide, our mortgage holder. They received the check on March 12 and were supposed to send one third of funds within 7-10 days. We have talked to their property claims dept. Numerous times daily since March 24, when they promised to overnight the check on March 26. They have given us two Fedex tracking numbers which have never been picked up. They insist every day that we will get the check by 3:00 P.M. Even though Fedex has never picked it up. This is no longer poor customer service, it is a matter of theft, fraud or mishandling of funds. Our contact at our insurance company says 85% of his claimants are having the same problem with their mortgage company, and the biggest percent of these problems are with Countrywide.
