National Foreclosure Counseling Service approached us, my girlfriend and myself, about loan modification via U.S. Mail. My girlfriend called and was told by a company rep. That for $2088, broken up into two payments, that their company could our mortgage company to lower our current mortgage by a least $300. We paid $1044 on 10-20 and was told that they would start after the second payment. On 11-03. We received a call from National stating that they had worked out a wonderful deal for us and gave us a figure that was $50 higher than our current mortgage. We told them that we
were not going to send a 2nd payment for a higher mortgage and was told that we could get our money back and just go into foreclosure. We then called our mortgage co. And got them to lower our payment by $200. At this same time, I received a voice message from National Foreclosure that our mortgage co. Would not work with them. Later that night National called
us again and conference in our mortgage co.in a attempt to broker a deal.
National was informed by both us and the mortgage co that an agreement had been worked out. The National Foreclosure rep. Kept us and, at times, our mortgage co. On the phone for the next two to three hours. We were told a refund would be issued and two days later we receive a check for $200. We called to find out where was the rest of our money and was told that she was being billed for keeping us on the phone for two hours. We at that time asked for a receipt and was not sent one. The request was repeated in the December and again ignored. Further research lead me to a law that was inacted two weeks before we sign our contract. This law stated that these companies are not to take money up front, they did. That on our contract it must have in bold, at least 12-point, uppercase letters;The cancellation clause and at state let us know that we could contact our lender for ourselves.
