Cellular-Blowout.com—Rip Off Artist

We placed an order with this company for a wireless phone for my daughter. When we placed the order, we were informed the product was in stock and ready for immediate delivery. With that said, we requested the 3 -day UPS for $19.85. Our credit card was immediately charged $244.80 for the purchase. After a 3-day wait, we noticed on the website that our order status stated our order was in fulfillment. We e-mailed the company and got a response stating they were sorry about the delay and our phone will be shipped by the end of the next week. Needless to say we didn't receive the phone. I called the number posted on the site for several days and never got an answer. We finally requested a cancellation on the order on 17 Aug. We didn't get a response on the cancellation until we had sent another three or four e-mails. The e-mail response stated the order was canceled on 16 Sep 2008 and to allow 10 to 14 days for the refund to process. Once again we waited and made several unanswered phone calls and e-mails. I finally got a response after expressing a desire to go to small claims. On 28 Oct they stated their credit processor responsible for charging my card had dissolved their relationship with Cellular-Blowout and now I had to go to my credit company and filed a dispute with them. I e-mailed back immediately and received a response right back from them telling me they were working on a project that would allow them to refund me via an alternate method. On 3 Nov someone using the name Armando apologized for the problem and told me the situation would be resolved very shortly. After a couple of weeks (24 Nov), I e-mailed once again to inquire on the status and this time I got a response from Jack telling me to initiate a chargeback through my financial institution. I have yet to hear anything back from the company despite several e-mails and phone calls. There has to be a way to get our money back while simultaneously bringing legal consequences to this company. As a member of the Air Force, I'm researching the statement listed on their website in which they claim to do business with the military. This statement is part of the reason I solicited their services in the beginning, but I've yet to find one Air Force agency who stated they used this company. I'm getting my papers together to file with small claims, but I wanted to find out if there are any other folks out there who were successful in recouping their money from this group. I'm also planning to put my personal experience out on the military websites and e-mail resources to share with the millions of military members who might fall for this company as long as I'm not doing it in a way that crosses legal lines.
