Punished My Husband for Customer's Mystery Shopper Check Scam

My husband worked as a banker for Wells Fargo in Albuquerque. A customer presented one of those bogus "mystery shopper" scam checks at his branch. His manager asked him to handle the deposit.

Although my husband followed all Wells Fargo security procedures in accepting the check for deposit, when it proved fraudulent 4 days later, he was placed on "paid administrative leave, pending investigation."

After paying him for 8 days, Wells Fargo stopped his paycheck. Not a word to us.

After 10 days, his branch manager told his (former) co-workers that he has been fired. Still no communication from Wells Fargo.

After 26 days, Wells Fargo cuts off his team member access, so he can no longer see his timesheets. No one from Wells Fargo has ever contacted him. His designated Human Resources contact person has never returned any of his phone calls.

After 35 days, we send certified letters to Wells Fargo Human Resources in Albuquerque, asking that they simply tell us my husband's employment status.

Now it's been more than 4 weeks, and Wells Fargo Human Resources still will not tell us whether my husband is still employed.

This means, among other things, that he cannot file for unemployment because Wells Fargo has not terminated his employment. If he quits, he won't qualify for unemployment.

(Not many banker's jobs floating around nowadays, and especially not right before the holidays, so we're going to need that unemployment money to put food on the table.)

And Wells Fargo apparently has no intention of paying him for his accrued 16 days of Paid Time Off, earned before his enforced leave... I guess they don't have to, as long as he hasn't been officially terminated.

We consulted an attorney, who told us there is nothing we can do. We can't force Wells Fargo to tell him anything. And if Wells Fargo does eventually fire him, we can't dispute that either.

My husband has been in unpaid limbo for going on 5 weeks now. What else can we do?
