Harassment and Property Damage (Criminal Mischief and 2nd Degree Criminal Trespassing)
The towing agent, was hammering my door for 3 minutes straight as I told my sister to tell him to leave. She greeted him at the door. She spoke to the repo man through the closed front door, explained that I was not available, and asked him to leave. He yelled through the door to my sister.
My sister indicated that he told her he had contacted the police. At this time the repo man returned to his vehicle. A about a minute later, backed his tow vehicle across the front lawn to reach the car he wanted to repossess, since another car was parked in front of it in the driveway.
Immediately, I contacted the police about the violations. The repo man quickly moved to maneuver the vehicle so that he could position it for tow. He could only obtain access to the rear of the vehicle due to the proximity of the car to the house. After hoisting the vehicle up by the rear for towing he continued to push and pull the car on it's locked front wheels to a point where he could remove it from the driveway. He then proceeded to drag the car on it's front locked brakes, across the front lawn around the house for sale sign, over the large rocks hidden under leaves, and down the street.
Police officer arrived and obtained his information as he filed a report for which I followed-up by filing criminal trespass and criminal mischief charges.
Here is a list of items that have not been returned and were with the vehicle at repossession.
1 pair of white frame D&G Sunglasses (made in China)
4 Ikea large carrying bags (blue bags sold in store)
1 Unused emergency red plastic gas container
1 Emergency Car/Medical Kit (first aid kit with emergency car tools such as flares, flat tire repair, pump, etc.)
1 Garage door opener
1 Long umbrella
$5 in center compartment change
1 Miniature waste collection container with drawstring top
4 Boxes of facial tissue (travel size)
2 License plates
1 Black Isotoner leather gloves
3 EZ Passes (1 for window and 2 for license plates)
I am also collecting data, so please contact me at badrepo aol com if you are/were a victim of harassment, criminal activity, and / or trespassing in the process of a repossession agent obtaining your vehicle. Please include your best contact info (email preferred) and as much details you can remember to include all businesses and financing companies involved.
I plan to create a comprehensive report and will be more than willing to share details of my findings.
