Charging tenants for repairs to apartment units

Morgan Properties at Oxford Manor Apartments in Mechanicsburg, PA has been trying to charge all and every one of their tenants for repairs to their apartment units even when the repairs needed are only routine maintenance needed from years of use like bathroom repairs and carpeting repairs.

Ellen Garner - [email protected] - has been very aggressive in billing tenants for each and every repair made to their apartment units. This activity is occuring both when the tenants are still living in their unit, and after the tenant leaves the unit. If the tenant leaves, the tenant is then billed at their next address.

A bill is issued with a threatening letter to be turned over to a collection agency in 10 days if the bill is not paid.

Oxford Manor in Mechanicsburg PA was trying to charge the former residents of Unit 73 on Oxford Circle for bathroom repairs (before they moved out) and the former residents of Unit 74 for new carpets.

My bill (sent to my new address) is over $500.00 currently just for cleaning, repairs to shades, and the new carpeting they want me to buy them. I am trying to get the bill reduced down to under $20.00 just for shades but it doesn't look hopeful. Ellen Garner is subbornly listing the cleaning charges of $85.00 (that is just tidying up and does not include carpet cleaning). The carpet cleaning has finally been scheduled after I threatened to sue them in small claims court. I expect the cost to be billed to me because that is what their procedures seem to be.

Oxford Manor Apartments in Mechanicsburg PA, charges only $200.00 for security deposit and makes you sign a very restrictive 1 year apartment lease. To break their lease will cost 5 MONTHS FULL RENT if you break it 4 to 5 months before the end of the lease period.

If you do pay the lease-break fee (3 months rent and 2 months rent "collateral damage" charge), you still get billed for cleaning the apartment and any repairs they feel you owe. If you did not professionally clean the carpets they charge you for that. The fees that they include rack up until they are way over the paltry security deposit, and then you get billed for the difference.

I had to ask all kinds of questions as to why the carpet was being replaced besides the fact that they said it was now "bad." This includes why as to worn spots, stain spots or tear spots? My questions about their carpets included specific questions such as how much square footage is "bad" now and why, how long that section has been in use (between my lease period and former lease periods), how long the manufacturer said that it should last, who the manufacturer was, if the manufacturer had a warranty for how much of the period that it was supposed to last, if the carpet was supposed to be stain resistent, if the carpet was rated for high traffic (like their too-small apartments with high traffic areas), etc.

Right now, they have agreed that the carpets need to be cleaned to try to avoid buying new carpet. This is because a lawsuit would identify them as ripping out the carpets without even trying to clean them first and simply charging a former tenant for new carpets.

Do yourself a favor, don't sign the lease. Try getting an apartment somewhere else other than Oxford Manor in Mechanicsburg PA.
