They said it was a 14 day free trial kit. I never recieved the kit, but they still charged me the monthly fee

I signed up for a 14 day trial for a work from home kit. I never recieved the starter kit that was promised and they still charged me a monthly fee of 39.95 and refused to refund it. Saying that because I did'nt cancel the membership, even though I never recieved the info they promised, I was still liable for the 39.95 fee.
