In August of Becky Fahy agreed to purchase a 3YO bay AQHA gelding from us. She did send me a money order for $ and told me the other $4500 would be coming in a week or two. The week or two turned into a month... Then another month... So I wrote up a contract stating that since the horse was apparently being bought on payments, she would have to a) insure the horse for $6500 b) pay 18% interest c) have the horse paid off the spring of 2007 when she received her tax refund.
She sent me an NSF check and pretty much has been nickel and diming me since. I wanted to have her return the horse (also in our contract if ANY payment or stipulation of our agreement wasn't met, she was to return the horse to Clark Quarter Horses in Fargo, ND at HER expense). She refused. I then told her I would be picking up the horse. She told my attorney that I couldn't do so without a court order... Please keep in mind that I still have his AQHA Papers, and am the LEGAL owner of this gelding.
Now, she is refusing to pay me interest. My lawyer has pointed out that it was ON THE CONTRACT that she signed. I have sent her a certified letter with the payoff amount and a date that it was due. Haven't gotten my receipt back from her.
At this point, if the gelding is not paid for by November 15th, I will consider him sold AS IS... No papers and GRADE.
I have talked to SEVERAL horse people in our area that have had similar experiences this woman. She has written MANY NSF checks, hasn't paid for horses she has purchased, and has misrepresented horses she has sold.
