Ripoff dishonest fraudulent deciet lies

We signed the contract april 29 with david nam president of orange general contracting.

As per contract paid $40,000 in certified checks to orange general contracting and the rest of the payments would be satisfied by construction loan from the bank.
As per contract they would hire the architect which is mr. Lee at cljy designs at 516-225-9700.

We were told the demolition company they would use is sano construction corp. At 718-961-4757 (joan)
we were told the architect/structural plans and demolition permits are being done and we were to move out the house.

We were told we need a llc. Which we created isakharov & co. Llc.

David nam told us that he already has contacted 2 korean banks for financing and they are interested, so not to worry.

We wanted to know why we cannot meet the architect and where were the preliminary plans and why wasn't anything done as of yet. This was a constant conversation with orange general contracting. We kept being told that it takes time and they are working on it.

We moved out the house and on september 29 at 11:00am we had a meeting with orange general contracting at their office. At the meeting we were told the following:

Demolition permits and application will take 6-8 weeks.
Demolition itself would only take less than 1 week.
Then we would get the approval resolution & preliminary plans within 2 weeks after knockdown for the bank to consider financing.

We would then get the vacant lot survey that was needed to complete the architect and structural plans and for the foundation, footing and shoring plan. The vacant lot survey would take 10 days or 2 weeks.

Then approval drawing & permit for excavation & foundation.

And meanwhile they would obtain the work permit for the new building & final approval drawings.
This whole process would take 4 months.

On october 28 at 8:55am i called stanley kim, the project manager with orange general contracting.
He told me they already filed for the demolition permits and for the fence permit an for the electric and gas disconnect approval and that the demolition guy is scheduling the gas & electric disconnect with con-ed
and that it would now take 1-2 weeks for all permits, depending on the dept. Of buildings and that it should be 1-2 weeks for gas & elec shutoff and fence to be up.

On friday november 18 i contacted stanley kim and i was told by stanley kim that the dob examiner has our application and we have to wait for him to make up his mind on what he wants done.

On friday november 18 boris isakharov contacted david nam and was told a meeting would be scheduled for monday november 21 at orange general contracting office.

On november 18 after i spoke with stanley kim, i called the nyc dept. Of buildings and was told that there is no application for demolition or any other type for my building by anyone. The lady there told me that my expediter, which is stanley kim, should have a reciept or documentation of filing. I called back stanley kim and asked for a reciept or documentation, and he responded by saying why do you need that. I don't have it

We were never called by david for a meeting on monday the 21st of november and after i spoke to stanley about the demo. Filing reciepts, david nam never picked up our calls to him since.

On november 21 we contacted the queens district attorney, filed a coplaint and were told it would take a while to investigate and that we should also contact the nyc dept. Of consumer affairs.

At 10am we drove to the office of orange general contracting and spoke to stanley kim who told us that david nam is out of town and that we need $110,000 more to go on with this project. We told him that was not part of the contract. He brushed that off and said the $40,000 we gave orange general contracting was given to the architect, mr lee we told again that this was not the contractual agreement that we and david nam, orange gc, had signed. He again brushed it off and stated you have to bring us more money.

On november 22 at 2:35pm we filed an online complaint and mailed out a packet with contracts and copies of checks to nyc dept. Of consumer affairs.

On the same day november 22 we contacted sano construction corp. At 718-961-4757 and boris isakharov spoke with joan there. Boris was told that stanley kim contacted them on june 17 and was sent out a proposal that was never responded to. Joan said she followed up on august 3rd 2005 and they didn't respond to that. We were told that sano was working on our house and recieveing permits and gas & electric disconnects for 7 months now. This was all lies.

On the same day november 22 we contacted the architect mr. Lee at 516-225-9700. We told him that we were told that all of the $40,000 was given to him to which he replied i never received and payment from orange general contracting. I am not very happy about what orange said we asked him for a statement about this and he stated i must speak to david nam this was a direct lie by stanley kim. The design was not complete, the architect did not get approved plans from the dob.

On november 28 we went to sano construction inc and met with the owner vinny and his assistant joan. We were told that you or your company never signed the contract that they sent you, but you told us that they were filing the permits and getting the electric and gas cut offs. This was all lies by mr. Nam. And his company.

On november 30 we contacted the architect mr. Lee from cljy design. He told me that he spoke to mr. Nam and mr. Nam told him that boris isakharov's project was eleminated and to send mr. Nam a bill. Why would mr. Nam eleminate the project without talking to us?

We sent a certified letter that was recieved by mr. Nam in december stating that we want the contract terms fulfilled or refund our money.

They do not respond to our calls. They have our money. And they are getting away with it. Please help!
