Timberun Apartments/Dalcor Properties Lied, Broke lease agreement, unhealthy living

I moved to Timberun Apartments, Houston, Tx, in Nov. I signed a years lease. I specified before I moved in, that we needed a quiet place to live, as my son worked graveyards and slept during the day. They lied.

The people above me literally sounded like a herd of Buffalo's, and this went on for many hours a day, and into the night, almost every day until they moved out 2 months later.

I made numerous complaints, and was told since these people had lived there for 5 years, they would move me. I did not have the additional money to move again, and did not think it was right these people were allowed to continue to do this.

I decided to let them see how it felt, when I had to give up my job, because lack of sleep. They apparently did not like it, and moved.

From day one, nothing worked right in the unit. The dishwasher never worked, and I asked for a replacement. I was promised over and over, and given numerous excuses as to why I was not getting one. I never did. It would not of been so bad, but the sink I had to use to do dishes in was old, cracked and stained, and one of those huge single sinks. I had to use a huge bowl to wash. I even told the manager about this, and she seemed amused. I did not find this funny at all. When you work hard, and pay the money for a place to live as I did, you tend to get upset when the management does not live up to the lease agreement.

I finally had enough, and notified HAA (Houston Apartment Assoc.). After this, I was being verbally harassed by the manager, and gritted my teeth until the lease was up. This manager, I learned left, because she was caught stealing from the management company. I also learned she was giving special treatment to her friends on that property. Anyway, a new manager came in, and I was thrilled, for a short period anyway. I thought, finally, maybe something will get fixed. She did send a crew over to fix the molded bathroom walls, but the day they came I was very ill, and did not want to inhale Sheetrock fumes, so I asked them to come back another day. They never did.

The manager sent the maintenance man to fix the dishwasher, which he tried to fool me into believing he did, and went back and told the manager he did. This was a lie. She then told me she ordered a new one. As I have said, I never got a new dishwasher.

A few weeks before I moved, my car got vandalized, and my sons car was being vandalized. I complained once again, of course, nothing happened.

When I talked to the maintenance man about the mold, he told me many people there were complaining about it, I then said well why is not not being fixed. He told me, they were trying, but there were many complaints.

When the lease was due up, I get a notice stating if I want to live there and pay the same rent, I had to sign another years lease, or the rent was going up $45.00 a month. I could not believe this.

The main reason for this complaint is, I recently got a copy of my credit report, and this company reported to them I owe $1,170.00. First off, I don't owe them anything. My deposit should of covered whatever. Second, they never notified me I owed anything to begin with. Then yesterday, I get a letter from this collection agency, trying to collect this money. As I said, I Never knew before the other day I owed them anything. What gives them the right to turn me or anyone else into the credit bureau, but not let anyone know they have an outstanding debt? Also, they broke the lease agreement from day one, but yet I still have to pay. I contacted HAA once again, and am waiting to hear from them, if they cannot help me, then I will go to TAA, Texas Apartment Assoc.

What most residents do not know is, they have more rights then led to believe, and some apartment properties know this, but neglect to tell them all the while breaking the lease agreement themselves, as Timberun/Dalcor Properties did.

I have photos of the restroom, with the mold, the leak stain in the ceiling that never got repaired. The mold on all the a/c vents. The kitchen sink, the dishwasher, and the lid off the sewer drain outside my front door, that remained off for months, and nothing ever got done about it.

I was willing to over look all this, but when I get a bill, but more so, when this company ruins my credit, I cannot sit back and not do something about it. I did not break the lease, I moved out at the end of the lease, I did not give notice, but that only means I forfeit my security deposit. I turned in my keys.

The saddest part of this all, I was an excellent paying resident, and if they treat people like me this way, I can only imagine how the others get treated. Oh, one last thing. The manager told me the management company were good Christian people.
