To Whom It May Concern,
I am contacting your office regarding the refusal of ANYTIME FITNESS to cancel my contract as well as the return of monies they illegally removed from my account, even after I had called and revoked my permission for them to continue doing so.
I signed an ongoing contract with ANYTIME FITNESS. One of the stipulations in my contract stated that they would "provide for my safety". It also allowed me to transfer to another club in the event I moved or was on vacation. I had no problem with this and was a member since 2007 without incident until I moved to New Orleans from Hammond, LA. The only club that was available to me was on the opposite side of the St. Thomas Housing project where there is regular gun volley. I wanted to terminate my membership. I was not willing to "take a bullet" to go to the gym. They could not guarantee my safety, they chose to position their facility on the outskirts of a housing project, riddled with drug activity and prostitution and I felt I had a valid reason for wanting to terminate my contract. They refused to cancel the contract. I contacted the billing company, ABC FINANCIAL who was debiting my account each month. They terminated my debiting as I had requested. ANYTIME FITNESS reactivated the drafting without contacting me or discussing this with me. As a consequence, they not only illegally removed money from my checking account without authorization but it resulted in overdraft fees as well. Yesterday, they had the audacity of having some belligerent bill collector call to harrass me even further. I would ask that you:
1) Discuss their billing practices with them
2) Force them to repay the money they illegally removed from my checking account AND reimbusre me for my overdraft fees.
I have all the necessarry paperwork with discussion dates and with whom I spoke from AnyTime as well as the Finance Company. I only spoke with a voice activated prompt from ANYTIME FITNESS. My calls were directed to the finance company. ABC FINANCIAL was the only live person with whom I spoke. I will be happy to make copies of my paperwork which includes my banking statement for your review.
