Vanderbilt Mortgage and Finance Inc
Mortgage Fraud

Vanderbilt Mortgage company is making it very hard for me to pay off the loan early. They are trying every trick in the book they can to discourage me. When I had the payments drafted, I tried to use the coupon that came with the statement to make an extra payment. They used it as a regular payment and not as an extra payment and did not draft the regular payment as they should. When I called and complained I was told that I have to send in a payment less than the regular payment in order ofr it to be regarded as an extra payment. When I asked them to correct it, I was told that they could not because the draft had already taken place. When I sent in an extra payment less than the payment amount, they loaned me the money to that extra payment and used it as a regular payment. That meant that I owed more in the interest amount and technically I was behind on a payment. Again, they did not draft out the regular payment. When I called and complained about this and asked them to fix it, this is how they fixed it. They took the next draft payment and used it as an extra payment and did not draft out the regular payment. That did put me behind a full payment. I called and complained again. The customer service said that I had to use a special coupon that I either had to order from them or go on line and get it to make extra payments. They did not fix the other problem. I asked to speak to the manager. I was refused. I contacted BBB. BBB contacted the bank and the bank finally fixed the problems that I was originally told could not be fixed. I still had to use the special coupons to make extra payments. Then the whole cycle started again. I sent in an extra payment using that special coupon along with PBO on the check. I did everything that I was told to do to make an extra payment. They still put it down as a payment and not as an extra payment. I tried calling the manager. There was no answer. I left a message. I also e - mailed the manager. I received no response from the manager. I did receive a phone call a couple of days later from a representative from the bank. She told me that if this occurs again that I was to contact her or the manager. She did not give me any information on how to contact her. When I asked why the manager did not answer her phone or why she would not call me back, the response I get was that the manager was out of her office for awhile. When I asked why the manager did not e-mail me back, the response was that the manager could not use the companies computer to respond to e-mails. I a customer service personnel to have the drafts stopped and that I would pay by check. I was told that if I did this then all of my payment history would be deleted and that I can never have my payments drafted again. I stopped the drafting anyway. When I tried to send an extra payment with my payment, they took it and made it all an extra payment. I did not know this until I received a phone call saying that my payment was late. I told the person that according to my bank statement they had received my payment. He agreed and said he would fix it. A week later, I got another phone call saying that I was late. Again I asked how when according to my bank statement that they had received my payment before it was due. I told her that this was mortgage fraud and that I would be contacting a lawyer. Another 4 days went by before I received a phone call from the bank. The lady told me what had happened and that she would fix it. The point being that I had to talk to 3 different people at the bank before it was corrected. Because of this, my credit score was hurt. The latest they have done is this. I sent in a payment and an extra payment with it. They accepted my payment but they used the extra payment as a partial payment instead of an extra payment. When I called and complained, the lady told me that the money was used as a partial payment because it only went for 2.5 months.in other words, the extra payment is used as a regular payment and would not come into effect until payment is due.instead of owing less on my account, I still owe the same amount. They refuse to let me make extra payments or pay my loan off early.
