Day Systems Scammed me into sending priority didn't pay me agreed upon price wont call me back

David Day of Day Systems in New Hampshire, is a manipulative, shady, deceitful, disrespectful, dishonest and extremely fraudulent individual.

He found me on eBay his eBay name is D! DAY, and offered more than the winning bid on a Panasonic Phone System. The only reason I decided to break the rules of eBay this one and only time was because the winning bidder also bid on 5 other items but backed out on buying them after the bidder won them.

So David Day of Day Systems emailed me and asked me a lot of questions about the Panasonic Phone System. He asked how many ports does it have, does it have the SD memory card? I answered all of his questions and even took additional pictures to show him everything before we made the deal. He offered me $150 which was much more than the closing bid on eBay.

Now for shipping I usually do Parcel Post through the United States Postal Service for all my eBay merchandise I sell. David then emailed me to call him. When I spoke with him, he was very nice and I answered more questions for him about the merchandise. I told him the item is sold as pictured and described in the eBay description and I don't have the side cover, I told him I would look for it but I don't think I have it. He then asked about shipping for the item. I told I only do parcel post shipping. He then said "I don't mind paying extra for Priority Shipping, it shouldn't be to much more". So I agreed to do Priority Shipping.

Our payment agreement was once I had the tracking information he would pay me for both the item $150.00 USD and the Priority Shipping $32.50. (I even told him you don't have to pay for the Ready Post Box or the packing which was shown on the receipt from the post office. I emailed him at the post office and told him shipping was quite a bit more than parcel post, and he said in his own words "Hey Matt I just got home—a bit later than 7PM. I guess Im stuck with paying that shipping, because I asked for it. Im kinda stunned at the price, though. I dont have your tracking info yet, and I have no way to pay you until you send me a PayPal invoice.

I sent him a PayPal invoice for a total of $184.50 that evening and I didn't get any return payment. I left the next day on a business trip and checked my email and still no payment. I sent a reminder to pay and sent an email as well. He contacted me saying what in the worlds going on? I got all these reminders about payment. He then said I will pay you tomorrow. Hence our agreement for immediate payment. The next day came and no payment. I called the post office and they said the package has been delivered and picked up already.

I then called him repeatedly and no answer. I emailed and text him, but no replies. Then later that night I get a PayPal notification saying payment received from David Day. I quickly check to see if the payment was correct and instead of paying my invoice he sent his own PayPal payment of $150. On the PayPal payment email he said "TDA-50 phone box priority shipping; missing side cover & internal card. Please send those pieces for the rest of the amount we agreed to. Thanks! Dave" I was so mad because he deceived me. He pushed me around and thought he could make the rules on my merchandise. This is not how business is done. If he was unsatified with the merchandise I sent and he already paid I would of done everything in my power to make it right and pay for return shipping and refund his money. I have 3 or so returns on eBay and all of the people gave me 100% positive feedback for amazing service and great refund policy.

I told him no that wasn't the deal and you knew exactly what the phone system came with. He replied only with manipulative emails and refused to pay me.

I then said I decline your offer and I want my phone system back. I even sent him a return shipping label and didn't ask him to pay to send it back. I have sent multiple demand to return the item and he hasn't replied to and of my demands.

He swindled me into priority shipping without any intention of paying for the merchandise. He thinks he has the right to tell me what he was going to pay for my merchandise. I have the right to decline his offer and get my merchandise back and he doesn't get that. I filed a fraud report to the United Postal Inspector and I am going to call all of the necessary government agencies who are willing to listen.
