Neimans Jewelry live auction was a fraud buyer price manipulation is going on

Subject: Problem with. Item number: 300277834785

To Neimans:

I have never seen this happen before. I was bidding on a live auction and hit the button when the bidding was at $250. My bid did not record for several seconds. There was only one floor bid of $950 before my bid recorded. My bid should of recorded at $260 When it did record after several seconds it jumped up to $975. This appears to be fraud. I want this bid to be retracted immediately. I will not pay for this item under any circumstances. Item number: 300277834785. I would also like to know who was the bidder at $950. This is crazy. I will not ever do live bidding again.

Ebay admits that this is a serious problem and says that I have to resolve the problem with Neimans:

I am very sorry to hear of your encounter. From how you describe the situation, it sounds as if you encountered a slow Internet connection.

From the time you had submitted your live bid, until the time your bid was received, the bidding on this item had increased. And in this situation when you have placed a bid in error and are recognized as the winning bidder, you'll need to contact the seller directly to resolve the issue.

If you explain what had occurred, most sellers are very understanding that a mistake like this can happen. Then all the seller has to do is file a standard "Unpaid Item" dispute on the basis that both of you do not wish to proceed with the transaction; by doing so the seller receives a refund on the Final Value Fee and you do not receive an Unpaid Item Strike.

EBay offers several methods of contacting your seller. If you want to ask a seller a question about an item you want to bid on, or have already bid on, you can use our email forwarding system. To do so, just follow these steps:

1. Go to the item page.
2. Click the "Ask seller a question" link. You may need to sign in.
3. Select the appropriate subject from the drop-down menu.
4. Enter your question, and click the "Send" button.

In addition, you will also find the expert and administrative contacts for the Live Auction on the catalog overview page. Most Live Auction sellers provide their specialists' email address and phone number. To view the catalog overview page, click the title of the auction at the top of the listing. If you have completed a purchase and are having difficulty reaching the seller by email you may want to call the seller. To obtain the seller's phone number, simply follow these steps:

1. Click the "Advanced Search" link at the top of most eBay pages.
2. Click the "Find Contact Information" link on the left side of the page.
3. Enter the seller's User ID and the Item number, and click the "Search" button. You may need to sign in.

EBay will send you an email with the seller's contact information, including phone number. At the same time, we'll also send the seller an email with your contact information.

Please remember that sellers can file an Unpaid Item dispute with eBay for each of their items that are purchased but not paid for. EBay will issue a strike on the account of the buyer who does not honor their obligation to pay (unless the buyer and seller mutually agree not to complete the transaction).

As you can see Neimans Jewelry will not admit to any errors or fraud and will try to make you pay for an item after their auction system malfuctioned or where their system had fraudulently raised the bid over $700 with out recording my bid first.
