I placed an order with this website on 11/27/07 and about 8 days later they sent me an e-mail stating:

The order you had placed, order number:-C148285, was on backorder but now we have that phone in stock and are working hard to get it shipped out to you.
We have been backlogged due to the overwhelming customer response and are working very hard to get everything back in order.
We value you as a customer and for your inconvenience we are offering you a free car charger.
We apologize for the inconvenience this delay may have caused you and look forward to serving you.
They sent me these e-mails about every 2 weeks. I used PayPal and my Bank was charged the next day ($108.21).
At first I didn't think anything of it because it was during the holidays. But then after about a month a half I tried reaching them by phone and all I got was an answering machine, and when I tried e-mailing them I would get nothing.
Since I placed this order using PayPal, I called PayPal to report this incident and to try to get my money back; they said that there was nothing they can do because there is a time period on when you can file a claim and that is must be within 45 days of the day the transaction took place.
They did however tell me to contact my Bank (Bank of America) and that they would work with bank to resolve this matter. So I called my bank and (at this time its already been 2 1/2 months) made a claim, they said the next time to report it much sooner because they can't do anything after 60 days. They only had about 14days to try to get my money back, but I was lucky because they were successful.
So the lesson learned from all this was that these on-line stores know the policies that PayPal and Banks have, they try to fool you with these backorder status crap just try to make you wait long enough to where it is too late for you to file a claim. So don't wait until its too late, as soon as you feel something is fishy go with your instinct and find out whats going on. I know now that before buying anything on-line I will make sure I research the website first before buying anything from them.
