My Shipment came in damaged but was insured by UPS and a claim was filed with the shipping carrier. UPS awarded the seller a reimbursement and the seller failed to send a refund. Now he has the $80.98 that I payed for the order and another $80.98 from the UPS claim.

The seller refuses to answer any and all emails from me through ebay or Yahoo. I have made over a dozen attempts to contact him.

I have kept all of the emails from Speed Fantasy and UPS also all of the emails I sent him trying to get a response or answers.

I looked into the other complaints made against his ebay store and it looks like he does this to people often enough to make one heck of a liveing off of it. This guy is just one nasty creep!

I have been fighting this deal for months now and I have proof that from the next day after I received the broken product that I've been trying to get my money back or a replacement.

This claim is too old for EBAY to help me with because I tried to contact the seller and work it out with him first.

Like a dummy I thought that I had done the right thing by filing with UPS first insted of EBay. I had no idea what time frame UPS would take.

I think that this guy knew that EBay only gives you 60 days to file a claim. That's why he feels that he doesn't have to pay me the money he owes me. The time is up and no one can help.

I have an email from UPS telling me that they had a hold up because the seller had not filed the necessary paperwork.

My order was purchased on ebay 1/24/06
My order with speed fantasy was paid for using PayPal on 1/24/06
My order was delivered via UPS 2/2/06
I contacted seller on 2/3/06 about the order being broken
2/4/06 the seller told me to contact UPS
2/6/06 I called UPS and asked for a pick up
Package was returned via UPS 2/7/06
2/15/06 the package made it's way to an Arizona UPS office for the damage investigation.
When I contacted the seller on 2/28/06 to find out the status of my refund the seller asked me if I had returned the package yet.
On 3/01/06 the seller had not filled out the claim paper work needed by UPS per UPS.
3/4/06 the seller said that the claim was filed and would be over soon.
The seller was paid the UPS claim on 3/6/06 per UPS
3/14/06 the seller said that he was waiting on UPS to give him the refund
I have not gotten a response from the seller from 3/14/06 on.
Here is a copy of my email from UPS telling me that the claim was paid.
Dear Autumn:
Thank you for your inquiry. I apologize for the inconvenience caused in
this matter. I do show that this claim was finalized with the shipper
on
03/06/06. Since claims are settled only with the shipper, you will
need to contact the company or party that sent the package for final
resolution. If the shipper has questions about the claim, please have
them contact UPS directly.
