You are right when you say your site can cause confusion. This is what your site says:

Promotional 3-day trial membership automatically extends to monthly membership for $34.95, if you decide to keep it. Your payment will ensure that our site will continue to run as flawlessly as possible, and satisfy your needs.
Your site says that if you decide to keep it. When did I decide to keep this service? Did I notify you at any stage? You will notice that during the three day trial I have not even used your service. During the first hour I discovered that your service was not for me.
Your wording on your site is misleading, there is a condition attached to automatically extending to monthly membership. That condition is that I have to decide whether to keep it or not.
By not cancelling it within 3 days does not imply acceptance. (You will notice that I have not made use of your service; nothing was downloaded!)
