Sent lab test results to wrong party - HIPPA Violation ripoff

I execute my work at a business/company, 5 days a week, but do not work for this company. I had a minor accident there in January that did require a trip to the local medical center.

I filled out the appropriate paperwork at the medical center, which noted the company I do work for, as well as my district manager, who faxed a copy of the required drug test paperwork, common for on the job injuries. This paperwork also stated the company name (who I actually work for), phone #, fax # and HR person to contact.

This incident occurred 1/20/06 - I was fine, made a joke out of the mishap and thought nothing more of the matter.in a weeks' time I was told that the HR person (where I had the accident and perform my job duties, but NOT who I work for) wanted to see me. This person requested my bosses number (my district manager), which I thought nothing of giving it out.

About 1 1/2 hours later, my boss called me to inform me that he had a faxed copy of my drug test results in his hand. He was upset, and not at me. First, these test results should never have gone to this companies HR person, nor, should this HR person have faxed these results to my supervisor. They should have been sent directly to the HR person at the Company I work for, which was clearly stated on all paperwork at the medical center. Both my District and Regional Manager's were upset at this invasion of my privacy, and complete neglect at the medical center in looking at my files paperwork.

I then called my home office and spoke to HR there. I was asked to go back to the medical center and have another test done as my Companies HR person had still not received the lab results.

When I went into a room at the medical center, the nurse stated that they already sent lab results, so I did not need another test. I informed her that my Company has yet to receive this information. The nurse then looked in my file & stated it was sent. I stood beside her then, as she had the signed release paperwork page with my & a nurses signature. I pointed out to her where someone added, above the nurses signature a statement saying " works at % %" and an arrow pointing to my name. I told I did not write that, nor was it there when I signed it.

I then directed her to the front page of the original paperwork I filled out upon arrival that clearly showed the name, address, phone #, etc. Of who I work for - I also looked thru this file to find the paperwork faxed by my boss, which also stated the same information and the fax # for the HR office these results were to be sent to. This nurse then said she would call my HR office and that this may need to involve her office manager.

I went out to my car, called my HR office to verify they received the info & that they did not need for me to redo this test.

The bottom line of the insult to my privacy is the fact that I did not pass the drug test. 1st, my immediate boss should not have been given this info, the medical center was negligent in reading my file, and the HR person where this accident happened should have known better than to act as she did.

No, I did not loose my job - but, I had to send to my HR office receipt of my doctors prescription, showing the need/reason for this medication. Now, everyone is aware of my medical condition, that for the past 3 years no one other than myself & my daughter knew about. Now, this HR person and all management know at the company I perform my job at, as well as all upper management of the company I work for. I have not been treated the same by any of these people since, and I am quite bothered by that.

I am a 53 year old single, self supporting responsible, hard working individual with a grown married daughter and 2 grandboys - not some young, goofy, irresponsible drug addict.

I have called a couple of attorney's - with only one, and for 300.00 consultation fee, will talk with me. Okay, after I pay my other bills, if there is enough left for your fee, I'll give you a call.

Is there any help out there or suggestions for me? Thanks for hearing me out anyway.
