Asset management group of konica minolta fraud to automatically extend lease payments into rental payments past end of term

I contracted to lease a Konica Minolta C 350 Business Hub copy machine from the local Sarasota office.in my Lease contract, the lease return is handled by the Asset Management Group of Konica Minolta Business Solutions in Wayne, PA. 60 month FMV Konica Minolta lease agreement #24702900.

On 8/24 I called Konica Minolta Business Solutions and spoke with a Mr. Michael Kennedy asking what the buyout amount of my lease was and the shipping address I would be required to return the machine freight pre-paid if I didnt buyout the lease. He told me he did not have that info, nor would have that info until early next year, when the lease term expired.

The key point here is that the lease agreement calls for an endless automatic extention of the quarterly lease payment amounts as quarterly rental payment amounts if the lessee (our company) does not give notice to buyout, or terminate with the responsibility to return the equipment, freight prepaid, to a destination of konica minoltas choosing.

On 1/5 I called Asset Management Group of Konica Minolta Business Solutions in Wayne, PA @ # 800-442-2158 and spoke with a Ms. Beverly Phillips who said, I cant give you the buyout amount of your lease nor shipping address we will require you to return the machine to if you dont buyout the lease, until you give us notice that your terminating the lease. Please see copy of my NOTICE TO TERMINATE LEASE attached that I immediately drafted and mailed to her attention via certified mail.

My notice went unanswered.

Subsequently I called back the Management Group of Konica Minolta Business Solutions in Wayne, PA @ # 800-442-2158 and spoke with a Dianna, who told me she was not a residual rep and could not answer my question, and transferred my call to Ms. Beverly Phillips voice mail where I left a message inquiring asking what the buyout amount of my lease was and the shipping address I would be required to return the machine freight pre-paid if I didnt buyout the lease.

My message went unanswered.

Subsequently on February 14 I called our local Konica Minolta rep Mr. Jonathan Malzan @ 941-932-5510 and asked him to help me. He said that the buyout amount would be negotiable, he did not know or handle the return shipment of the machines, and that I needed to get my answers from the Asset Management Group of Konica Minolta Business Solutions in Wayne, PA.

I then called the Management Group of Konica Minolta Business Solutions in Wayne, PA @ # 800-442-2158 and left another message.

My message went unanswered.

Subsequently I called Konica Minolta Lease processing center @??? -736-0220 and spoke with a customer service agent Ileana, who said shes follow up and have someone call me back. No one returned my call.

On the morning of April 1, I called the Asset Management Group of Konica Minolta Business Solutions in Wayne, PA @ # 800-442-2158 and again left a message for MS. Beverly Phillips.By early afternoon, after I had not received a call back from Ms. Phillips, I called back again and spoke to an agent who said that Ms. Phillips was out of the office and unavailable, and in her absence, I should speak with her assistant, Mr. Tom Rakowski.

I was transferred to Mr. Rakowski who again refused to answer my question stating that it didnt matter that I had sent in my Notice to terminate. That it didnt matter that I was current in all of my service billings. That the policy of the Management Group of Konica Minolta Business Solutions in Wayne, PA was to NOT TELL THE CLIENT WHAT THE BUYOUT AMOUNT WAS, NOR WHAT THE SHIPPING ADDRESS IS TO RETURN THE EQUIPMENT, FREIGHT PRE-PAID, UNTIL I HAD PAID THE FULL AMOUNT OF THE FINAL INVOICE. THE INVOICE THAT I HAD NOT YET RECEIVED NOR PAID.

I feel it is a purposeful and intentional act by Konica Minolta to refuse to provide our company the rightful information we seek to make the business decision to buyout or return the leased equipment BEFORE the end of the lease term in order to FORCE US to AUTOMATICALLY extend the contractual payments in 90 day RENTAL increments. This is flagrant attempt to extort further payments from my company past the end of the lease term.
