No contract plan, hidden charges

I signed up for T-Mobile service in September with a contract for a new Android smartphone. A short time later, I switched to an "Even More Plus Unlimited" plan which includes NO contract. Before switching to this plan, the rep told me I would not be eligible for upgrades with this plan since it had no contract, to which I agreed. I do not recall any other negatives being mentioned at the time. After about a year of good service, last month the latest Android software update was being sent out to people automatically. Mine showed up one day, so I went ahead and downloaded it to my phone, which was a huge mistake. My phone was still just fine for phone calls and texting, but the internet became very glitchy and I had difficulty reading my emails. My mom had the same phone (a MyTouch 3G), and hers was acting exactly the same after the update. I called customer service several times around November 20th seeking some type of assistance, but the only suggestion they had was to do a phone reset (which did nothing). The "best" they could do was to sell me a new device at full cost (since I had no contract), or to sign me up on a contract plan and get a new device at a discount. Angry, I got off T-Mobile and switched to AT&T on November 21st. Last week around December 16th, I received a surprise bill from T-Mobile... On it was the remaining final balance from November (which I expected), but also a $200 early termination fee, and about $38 in taxes for a total of 319.75! Confused, I called T-Mobile again and the rep told me that indeed I did have to pay an early termination fee. Apparently, when you switch from a contract plan to a "no contract" plan, you are still under the initial contract term for the remainder of your time remaining. This is ridiculous and is something many of the reps are failing to tell people since the whole thing is totally misleading. It seems like it is really just a scam for T-Mobile to not only unknowingly get early termination fees, but also sell more devices at full price. What really makes me mad though, is that T-Mobile's software update made my phone go bad, and now I am the one having to go through a huge hassle and pay all of this money for something THEY caused... Which is the only reason I got rid of them. Thanks T Mobile for nothing, I will never be a customer again!
