I recieved a defective item and i hold documents stating that it should work properly but when i recieved the disc it was cracked down the middle being held together by tape

I purchased an item off of ebay march, 25 2008. I recieved the item march, 29 2008. When i recieved the item (disc) it was cracked down the middle being held in a stable position with tape. I have sent the seller numerous amount of e-mails and i have not recieved any response since the day i recieved it. I hold printed documents with all of the policies and return agreements this company provided me. With one stating that the item will work perfect when i recieve. Also it stated that it was used. I was aware of it being usd but not aware of it being split down the middle
