Fraudulently renews contracts. Ripoff

I am an attorney and I read all contracts I enter into. I work for a large corporation and deal with customer service errors on a daily basis, so I know how careful I have to be when I deal with customer service reps in my own personal life. I don't believe that Sprint met the requirements under the federal Electronic Signature Act (Act) when it claims that I renewed my contract by changing rate plans.in order to have a binding contract with me, it must meet the requirements of the Act.

The only reason I switched to Nextel was so that I could use mobile tracking to find my teenage daughter if she was in trouble. Imagine my surprise when I was told that I renewed my contract for two years, a year past my daughter's graduation. I did change rate plans in March but I specifically asked about the ramifications of a new plan on my contract status and I was told that there would be no effect on the contract status. When I found out that the status of my contract on their system is that I am under contract until March I asked to speak to a supervisor. I asked him to pull up the recorded conversation and listen to the customer service rep tell me that there would be no renewal. He refused to do so and told met that it was not possible to listen to the conversation.

I work for a company that is much bigger than Sprint/Nextel and I can at any time order a copy of a conversation with any customer service representative going back several years. If Sprint is relying on the contract to have been created under the Act, it must follow those requirements of the Act. That means it must be able to prove that I agreed to the contract. The only way it can do that is to retain a copy of the conversation.

So, either they have no record of my agreement or they never obtained my agreement. I don't believe Sprint has a binding contract with me or anyone else that its representatives decieve in such manner. I would be interested in hearing from anyone that has pursued this avenue with Sprint.in the meantime, I am writing to Sprint, pursuing the contractual issue and will post future updates if anyone is interested.
